Mr Elliot was fined $300.

Facts:

Following the running of Race 1 (Methven Tapware Supporting Life Education Trust Mdn), Information No.A7324 was filed with the Judicial Committee. It was alleged by the Informant that Mr Elliot the rider of LA ACHIEVER used his whip excessively prior to the 100m.

Rule 638(3)(b)(ii) provides:
A rider shall not: (b) strike a horse with a whip in a manner or to an extent which is:
(ii) Excessive.

Mr Elliot acknowledged that he understood the Rule, the charge and confirmed that he admitted the breach.

Mr Goodwin showed the relevant film replays and said that Mr Elliot stuck his mount 4 times and then only gave a break of 3 strides prior to using the drawn whip again. He said that that was outside the whip use guidelines of 5 on - 5 off.

Mr Elliot in response said that he got a bit eager from the 200m.

Mr Harris said that Mr Elliot had not given the 5-stride respite, and perhaps it would have assisted Mr Elliot if he had have gone back to the rein with his whip hand following the initial strikes. He said that he agreed with the Rule, but that some jockeys are having a problem with the counting together with the other aspects of race riding.

Submissions for Penalty:

Mr Jones said that due to the re-set period being from 1 August 2017 that Mr Elliot had a clear record as he had not infringed since that date.

Mr Elliot confirmed that the charge was the first since 1 August.

Reasons for Penalty:

The JCA starting point for a first offence is $300. As the Committee considered the breach to be in the low-end category it did not depart from the starting point.
