Accordingly Mr Turner is fined the sum of $300.

Facts:

Prior to Race 1, an Information was lodged by Mr N Goodwin alleging a breach of Rule 330(3) (c) in that Dylan Turner failed to make the carded weight for STANLEY in Race 1.

Mr Turner acknowledged he understood the rule and the nature of the charge and confirmed that he admitted the breach.

Mr Goodwin told the hearing that Mr Turner notified the Stewards 1¼ hours before the first race of the fact he would not be able to make the weight for his ride on STANLEY in Race 1. Mr Turner told the Committee he had ridden track work in the morning and had 700g of weight to lose. Despite time in the sauna and the spa the weight would not come off.

Submissions for Penalty:

Mr Goodwin said Mr Turner had breached this rule in April and May where he was fined the sums of $100 and $200 respectively under the minor infringement schedule. He called for a monetary penalty in excess of $200.

Reasons for Penalty:

Mr Turner has appeared before the Judicial Committee because he breached the overweight rule for the third time within a three month period.

In considering penalty the Committee took into account Mr Turner’s record which does not show a history of regularly presenting overweight. He was replaced today by Mr Bradley, another senior rider, therefore in our opinion the betting public was not disadvantaged by Mr Turner being replaced on STANLEY. We also had regard to other similar breaches of Rule 330 (3) (c) when arriving at an appropriate and consistent penalty.
