Decision:

The charge of careless riding preferred against Apprentice Jockey Mr D Turner was found to be proved.

Penalty:

Following discussions with Mr Turner as to his upcoming riding engagements, it was determined that his Apprentice Jockey Licence be suspended from the close of racing on 27 December 2015 up to and including racing on 1 January 2016 (3 riding days).

31 December -  Stratford RC
1 January 2016  - Hawke's Bay RI

Facts:

Following the running of Race 1 (Landmark Homes Maiden) Information No. A6836 was lodged with the Judicial Committee. It was alleged by Mr Goodwin that D Turner permitted his mount TERRACOTTA WARRIOR to shift inwards forcing SLEEK SECRET inwards crowding PENNY BLACK which was checked near the 800m.

Rule 638(1) (d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Turner confirmed that he did not admit the breach and said that he understood the Rule and the charge that had been preferred against him.

Submissions for Decision:

Mr Oatham showed the films and identified the horses as TERRACOTTA WARRIOR (D Turner) racing 3-wide, to his inside was SLEEK SECRET (K Myers), and to her inside was PENNY BLACK (R Elliot).

Mr Oatham said that as they approached the 800m, Mr Turner shifted in and forced Miss Myers in and that R Elliot ran out of room and was forced to check. He said that Miss Myers had wanted to stay out, as her horse’s head was angled outwards. He added that Mr Turner’s mount made contact on two occasions with Miss Myers’ horse. However he added that the contact was minor.

Mr Sharrock asked Mr Oatham to show where contact had been made. Mr Oatham replayed the head-on video and demonstrated where he believed contact had been made.

Miss K Myers and Mr R Elliot were called to give evidence.

Miss Myers said that her instructions were to sit in the one-out, one-back position and that Dylan (Turner) had followed Robbie’s (Hannam) mount across and had put slight pressure onto her and that she was dictated inwards. She said she went from a 3-wide position to one-off the fence. She added that her horse was light in the mouth and that that had not helped.

Mr Sharrock asked Miss Myers if she was aware that R Elliot was there (back on her inside)?

Miss Myers answered that she was not aware that he was there and that if she had have been, she would have called out to Dylan to stay out.

Mr Elliot said that Miss Myers came in on the first bend (800m) and said that she was clear, that he had tried to pull back and get his horse to relax; he added that she was entitled to the gap and was probably about ¾ of a length clear.

In answer to the Chair for clarification purposes, Mr Elliot said that Miss Myers was ¾ of a length clear in the approach to the 800m, shifted into his line and he was checked.

Mr Sharrock put it to Mr Elliot that his horse had over-reacted when he tried to pull it back.

Mr Elliot wasn’t sure whether that was the case and appeared to be somewhat reluctant to answer the question.

In summation Mr Goodwin submitted that Mr Elliot’s mount had been over-racing but had settled prior to the 800m. He said that he was entitled to be where he was, but that Mr Turner had angled his horse inwards and had dictated Miss Myers in on Mr Elliot. He said that Mr Turner did come out, but that it was after the interference. He concluded by submitting that in the opinion of the Stewards, Mr Turner had ridden carelessly.

Mr Sharrock, on behalf of Mr Turner, said that there had been little contact and that Dylan had had no idea that he (Mr Elliot) was there.

Mr Turner was given the opportunity to speak but elected not to do so.

Reasons for Decision:

Following careful consideration of all the evidence and in particular that of Miss K Myers, whose evidence was very clear indeed, and the head-on video, the committee found that near the 800m Mr Turner allowed his mount TERRACOTTA WARRIOR to shift in onto Miss Myers’ mount SLEEK SECRET when not sufficiently clear. As a consequence PENNY BLACK (R Elliot) who was racing inside SLEEK SECRET and adjacent to the running rail ran out of racing room and was checked.

Submissions for Penalty:

Mr Goodwin said that Mr Turner’s record showed that he had not been charged with careless riding for over 12 months. He said that Mr Turner’s movement was minor, but that Mr Elliot’s mount received a severe check. He asked the committee to take into account Mr Turner’s very good record and that the riding was not over-zealous, however he believed a term of suspension was appropriate.

Mr Turner confirmed that he had not been suspended for 14 months but had nothing further to add regarding penalty.

Mr Sharrock said that it was a busy time for Mr Turner with several meetings coming up and asked that a fine be imposed rather than a term of suspension.

The chair explained to Mr Sharrock and Mr Turner that it is not the policy of the JCA to impose fines for breaches of the careless riding rule. Mr Sharrock then suggested that under those circumstances that a 3-day suspension be imposed as it was minor movement.

Reasons for Penalty:

Albeit Mr Elliot’s mount received a relatively severe check, it was the committee’s opinion that the carelessness displayed by Mr Turner was at the low-end. Taking into account Mr Turner’s excellent record and the starting point of 5 days suspension for careless riding, the committee believed that a 3 riding day suspension was the appropriate penalty.
