As Mr Turner admitted the breach we found the charge proved.

Penalty:

Mr Turner is suspended from the close of racing today, Saturday February 18 up to and including racing on Thursday March 2nd. This equates to four Central Districts days:

26/2/17 - Wairoa
2/3/17 - Hastings

Facts:

Following the running of Race 4 (Phoenix Park 2YO Classic), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that D Turner allowed his mount to shift out when not sufficiently clear of ICEBOMB passing the 800m.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Turner confirmed to the Committee that he understood the charge and he admitted the breach.

Mr Balcombe used the films to identify the individual runners involved. At the end of the back straight Mr Turner was in last place with his mount, IRISH FLAME, racing keenly. In an effort to find clear racing room Mr Turner angled his mount out and pushed ICEBOMB (Mr McKay) wider on the track. Mr Goodwin said that Mr Turner should have taken a hold of his mount instead of making his own run.

IRISH FLAME won the race with ICEBOMB running second. Mr McKay looked at lodging a protest but due to the significant margin between the two horses at the finish he elected not to proceed.

Mr Turner agreed with Mr Goodwin’s assessment of the incident. He said he “missed the kick” at the start and hunted his horse up to the rest of the field. IRISH FLAME was racing ungenerously for him and he shifted out when not clear of ICEBOMB to his outside.

Submissions for Penalty:

Mr Goodwin said Mr Turner had a very good record with only one recent careless riding charge incurred on January 1st at Hastings. A previous charge, almost one year ago, arose from an incident in March 2016. The Stewards placed the degree of carelessness below midrange and submitted a term of suspension was appropriate. Mr Goodwin said although the interference forced ICEBOMB wider on the track he did not believe this movement made a difference to the final placings.

Mr Turner said that over the last few months he was averaging 6-8 rides per race meeting and on that basis his record was a good one. He drew the Committee’s attention to his admission of the breach and asked us to consider a combined penalty of suspension and a fine.

Reasons for Penalty:

The Committee advised Mr Turner of the five day starting point for careless riding charges as outlined in the Penalty Guide for Judicial Committees. We also explained that it was not a general policy to impose a combination penalty of a period of suspension and a fine.

We took into account the Group 3 status of the race but the Stewards played the films through until the finish and made it clear that the interference had no bearing on the final placings. We accept that Mr Turner was always comfortably holding his position ahead of ICEBOMB despite Mr Turner carrying that runner wider on the track.

Taking into account Mr Turner’s good record, his ready admission of the breach and the low level of carelessness we found it appropriate to impose a four day suspension.
