As Mr Bosson has admitted the breach the committee find the charge proved.

A penalty by way of a fine of $300 shall be imposed.
Charge:
Mr O Bosson failed to make the carded weight for JACKABEAN in race one.
Facts:
Mr Goodwin informed the committee that O Bosson had contacted him prior to 7.30am to inform him he would be unable to make the carded weight of 57kg, required to ride JACKABEAN in race one. Mr Bosson had left home the previous day for accommodation in Manawatu. Knowing he would as usual have to lose weight on race morning, however the facilities he had and did try to use were unsuitable.
Mr Bosson confirmed he had rung the stewards after he had tried first at his accommodation to use a hot bath which did not work, he then went to a fellow jockey’s residence to use his hot bath which he did, but by then ran out of time before he had to leave for New Plymouth. In answer to a question in regard to his current weight Mr Bosson replied that it was a normal occurrence to have to lose weight on race day, but on this occasion having just returned from holiday and not using his own facilities he had been caught short.
Submissions for Penalty:
Mr Goodwin in presenting Mr Bosson’s previous breaches under this rule of two charges from 30/4/11 and 21/5/11 asked the committee to consider that Mr Bosson is not a natural lightweight and as a senior and successful rider he has attempted to the best of his ability under the circumstances available and has failed to make the weight for only one ride.
A penalty by way of a fine over the sum of two hundred dollars that being the last penalty imposed on Mr Bosson for this breach is submitted.
Mr. Bosson reminded the committee that he tried as best that he could and did give early notification to the stewards and would leave the penalty in the hands of the committee.
Reasons for Penalty:
Taking into account Mr. Boson’s early admission of the matter, his previous record for a very busy rider, and the attempt that he did make to reduce his weight, this did affect one mount for the day. He did however have to be replaced as the rider of JACKABEAN.
