Facts
On 23 April 2015 Information No. A6805 was lodged with the Judicial Committee. The Information alleged that in Race 2 (Energy City Cab Highweight 2000m) at the Taranaki Meeting on 2 April 2015 that Mr Niall Quinn the rider of BILLY ELLIOT angled his mount outward passing the 700m when not clear of SONTANA (S Fannin) which was tightened and fell.
Written approval from the Management of the R.I.U was presented permitting the Stipendiary Steward to proceed with the charge.
Rule 638(1)(d) reads:
That a rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Quinn acknowledged that he understood the Rule, the charge and confirmed that he did not admit the breach.
Evidence
All relevant films were shown and Mr Whiterod identified all horses and riders that were involved in the alleged incident. Mr Whiterod said that approaching the 700m Mr Quinn who had been racing adjacent to the running rail, angled his mount out when only half a length clear of SONTANA (S Fannin) forcing that horse out onto CANDY BELLE (T Harris) resulting in SONTANA running out of racing room and falling. He added that there was insufficient room for Mr Quinn to come out.
Mr Quinn and Mr Myers did not have any questions of Mr Whiterod.
Mr Quinn said that he was not racing adjacent to the rail; he said that he was about a half a horse width off the fence before any shift took place. He said that he had held his line going forward and that you could see that Mr Fannin racing on his outside had his horse’s head turned inwards. He said that this was because CANDY BELLE had shifted and that he (S Fannin) was trying to get away from him.
In answering questions from Mr Goodwin Mr Quinn said that Mr Harris was racing a bit more than 3-wide, that he did not hear a call and that he was not aware that a fall had taken place until after the race was finished.
Mr Myers, assisting Mr Quinn, said that the gap Mr Fannin was in was his and that Mr Harris decided to shift to the inside of the horse in front of him and that this was when Mr Fannin and his horse got tightened. He said that Mr Harris should have gone 4-wide around the horse in front of him and not to its inside. He added that Mr Fannin pulled off Mr Harris’ horse’s heels and not Mr Quinn’s. He said that Mr Harris was not a length clear when he shifted.
As there was clear conflict in the evidence presented by the informant and the respondent the committee asked that Mr Harris be called to give evidence. Mr Harris said that near the 700m he was racing 3-wide following another horse directly in front of him. He said that the only time he shifted was when the horse on his inside hit his horse’s near-hind quarters and turned his horse inwards. He added that up until then he had always stayed straight. Mr Myers put it to Mr Harris that he had shifted inside of the horse in front of him and that this caused the tightening. Mr Harris reiterated that the only time he shifted was when the inside horse came out and hit him.
As Mr Fannin sustained concussion as a result of the fall and had no recollection of the incident, he was not called as a witness.
In summation Mr Goodwin said that there was not sufficient room for Mr Quinn to shift when he did and that if he had not shifted the fall would not have happened.
Mr Quinn said that he had nothing further to say.
Reasons for Decision
The committee reviewed the films at length and carefully considered all the evidence. The committee found that near the 700m Mr Quinn allowed his mount to shift away from near the running rail when not the required distance clear of SONTANA, this resulted in SONTANA being forced out onto CANDY BELLE. As a consequence of the shift SONTANA ran out of racing room, appeared to clip heels and fell. The committee was satisfied that the only time CANDY BELLE shifted was when it received pressure to its hind-quarter and was turned in. We considered that Mr Harris’ evidence was clear and concise and that he did not waiver under cross-examination.
Decision
As a result of the committee’s finding the charge of careless riding preferred against Mr Quinn was proved.
Submissions for Penalty
Mr Goodwin said that Mr Quinn had a very good record and that this was the first time he had been charged with careless riding. Mr Goodwin said that the Stewards have a starting point of requesting a one month suspension be imposed when a fall occurs, rather than a number of racedays. In answer to a question from the Chair regarding treating jumping jockeys differently to flat riders due to the limited opportunities jumping jockeys have, Mr Goodwin said that if a month’s suspension was imposed it would amount to only 7 racedays where there are opportunities for jumps jockeys.
Mr Quinn said that the jumping season is very short, that in working for Mr Myers there is also the possibility of riding in Australia. He said that he has not ridden in Australia in the past but was looking forward to doing so. He added that he would like any suspension imposed to start after racing on this day.
Reasons for Penalty
The committee took into account the following matters when assessing quantum of penalty;
Mr Quinn’s excellent record, the carelessness exhibited was deemed to be no less than mid-range, that another horse and rider fell and that Mr Quinn is a jumping and highweight rider who has limited opportunities.
Generally penalties imposed on such jockeys are less than those imposed on jockeys who have greater opportunities. Giving careful consideration to all of these factors plus the starting point it was determined that a 6 riding day suspension be imposed.
Penalty
Mr Quinn’s Jockey’s Licence was suspended from the end of racing on 23 April 2015 up to the close of racing on 17 May 2015 (6 days).
