 As R Myers admitted the breach, the committee finds the charge proved.

Penalty:

Miss Myers is suspended from riding from the close of racing on Friday 25 November up to and including Thursday 1 December (4 days).

Charge:

In that shortly after leaving the barrier, R Myers (rider of LADY BELLE) permitted her mount to shift in when not clear of JUSTGO XENA and ARCTIC HEIGHTS which were checked.

Miss Myers confirmed she did admit the breach and understood the rule as read.

Facts:

Mr Goodwin, when using the films available and in particular the head on view, explained to the committee where R Myers (when starting from barrier 13), on her inside was JUSTGO XENA (J Parkes) and inside that horse was ARCTIC HEIGHTS (J Waddell) allows her mount to shift across and place pressure on to J Parkes who is forced to check his mount, who in turn goes across onto J Waddell. Miss Myers was never clear of Mr Parkes' mount.

Miss Myers confirmed Mr Goodwin’s interpretation of the incident.

Submissions for Penalty:

Mr Goodwin, in presenting R Myers' previous riding record, informed the committee of only three charges in the past season and considering the number of rides she has had, it is a very good record. The Stewards regard this offence in the mid to low end of the scale and submit a penalty by way of suspension of less than five days.

Miss Myers informed the committee that she would seek to use the seven-day deferment and any suspension to begin after Friday 25 November, and that she is a national rider.

Reasons for Penalty:

In reaching a penalty, the committee have taken into account R Myers' early admission of the breach, her very good riding record as mitigating factors, and the degree of carelessness at the mid to low range when moving in affecting two horses, as aggravating factors in reaching a term of suspension.
