Decision:

The Committee find the charged proved.

Penalty:

Miss Whelan is suspended from riding from the close of racing on Sunday 15th May to the close of racing on Friday 20th May. (three days).

Charge:

Following the running of race 4 an information was filed by Stipendiary Steward R Neal alleging that L Whelan permitted her mount "Andeni" to shift out rounding the home turn when not clear of 'Excuseable" which was checked.
 

Facts:

Mr Neal using the head and inside home turn video films identified the three horses concerned in the alleged incident, these being several horse widths off the running rail with "Andeni" in the lead, "Excuseable" outside and three quarters of a length back and outside the horse "Iwouldificould". At this point, Miss Whelan has shifted out into the line, of which Mr Bosson was entitled, and he was squeezed between "Andeni" and "Iwouldificould" and was checked.
 
When questioned on where the pressure came from causing his check Mr Bosson indicated it came from Miss Whelan on his inside.
 
Miss Johnston when questioned indicated the pressure to her came from "Andeni' while she was attempting to hold her own line whilst receiving pressure from 'Excuseable".

Miss Lockett using the films available to her indicated to the committee where Miss Johnston has put as much pressure on Mr Bosson, by moving inwards as to what Mr Bosson has received from Miss Whelan moving outwards.

Miss Whelan in her own defence indicated to the committee that she maintained her own rightful line and has not drifted out.

Reasons for Decision:

In reaching a decision the committee has taken all the evidence presented and after viewing the video footage it is clear from the evidence from both witnesses and the film coverage, there clearly was pressure by Miss Whelan drifting out into the rightful line of Mr Bosson, and therefore causing him to check his mount. The committee does not support the suggestion of any inwards pressure by "Iwouldificould".
 

Submissions for Penalty:

Mr Neal presented a clear record for Miss Whelan as this is her first ever offence under this rule. Miss Whelan is deemed a national rider and has been riding since September 2010. The Stewards deem this a significant check, but also accept Miss Whelan’s inexperience and ask the committee to consider those matters by way of penalty.

Miss Lockett informed the committee that Miss Whelan is becoming a very much sought after rider and while she may have erred on this occasion sought leniency by way of seeking a three day penalty.
 

Reasons for Penalty:

Taking into account this is Miss Whelan’s first charge, having a very good riding record within nine months and approximately a hundred plus rides the degree of interference and judgment of a low to mid range penalty the committee impose a term of suspension.
