Facts:

Following the running of Race 6 (Salty Dog Cafe & Bar Mobile Pace) Information No. A4204 was filed with the Judicial Committee. The Information read that BRANCH RICKEY which finished fourth was lapped on by GET HOME TYRON which finished fifth.

Mr Gibbs the Trainer of BRANCH RICKEY endorsed the Information that he did not contest the protest.

The Judge’s placings were:

1st No.1 RIGHTEOUS ROYALE
2nd No.4 BETA B QUICK
3rd No.8 NO LIABILITY
4th No.10 BRANCH RICKEY
5th No.11 GET HOME TYRON

The margin between fourth and fifth was a half-head.

Rule 870(5) reads:

Notwithstanding the provisions of sub-Rule 4 hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gate shall be placed by the Judicial Committee behind such horse or horses. Provided that where such first mentioned horse is not in its correct gate as a result of interference to such horse, or its horseman, then (subject to Rule 8698) such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr Muirhead showed the films and said that with approximately 30m to travel BRANCH RICKEY who was in third position, shied at the winning post, broke and veered out abruptly and was lapped on by GET HOME TYRON. (A half head separated the two runners).

Reasons for Decision:

As BRANCH RICKEY was clearly lapped on by GET HOME TYRON the committee in accordance with Rule 870(5) determined that BRANCH RICKEY be relegated to fifth placing.
