Following the running of Race 1 Mr McCaffrey was charged with a breach of Rule 869(2)(a) in that "SL McCaffrey the driver of CON SPIRITO used his whip excessively over the concluding stages of this Race".
Mr McCaffrey signed the Information admitting the breach. Stipendiary Steward Mr Taumanu stated Mr McCaffrey did not wish to attend the hearing and the hearing proceeded accordingly.
Rule 869(2)(a) states:- "No horseman shall during any race........use his whip in an unecessary, excessive or improper manner" .
Facts:
Mr Taumanu used the side-on film of the race and identified Mr McCaffrey driving CON SPIRITO and leading the race on entering the home straight for the final time. He said that in the run down the home straight Mr McCaffrey used his whip 20-21 times which the Stewards deemed to be excessive.

The Committee has reviewed the film of the final stages of the race and notes Mr McCaffrey struck his horse between 20 and 21 times in the home straight with some of the strikes close to the finish line being quite forceful. Mr McCaffrey ended up running fourth in the race and what made the incident more noticeable was that the drivers who finished in front of him did not strike their horses anywhere the number the of times he did. The Committee also takes into acccount Mr McCaffrey's admittance of the breach and the fact that he has not breached this Rule in the last 12 months. Finally the Committee has also reviewed the JCA's penalty listing to ensure any penalty given is consistent with those given previously where the breach of the Rule is the first for 12 months. Taking all those matters into account the Committee believes on this occasion a fine is an appropriate penalty.
