As Mr Laidlaw, on behalf of Messrs Rogerson and Blanchard, has admitted the breach of the Rule the charge is proved.

Penalty:

On this occasion the Committee believes a fine is an appropriate penalty and Messrs Rogerson and Blanchard are fined $200.

Charge:

Following the running of Race 5 the Rogerson/Blanchard training partnership were charged with a breach of Rule 865(2) "in that JESSIE MAGUIRE was presented without removeable deafeners".

Rule 865(2) states:- "Every horse entered in a totalisator race shall be presented in the assembly area prior to the race in the same notifiable gear as that notified under Sub-Rule 1".

Mr Laidlaw confirmed that he understood the Rule.

Facts:

Mr Muirhead said when JESSIE MAGUIRE was presented to the birdcage prior to Race 5 it was not wearing removeable deafeners. He said Mr Blanchard had notified HRNZ on Friday that the gear was to be worn but had failed to notify Mr Laidlaw who, as a consequence, presented the horse in the incorrect gear.

Mr Laidaw had no comment other than to agree with the facts as outlined by Mr Muirhead.

Submissions for Penalty:

Mr Muirhead said this was Messrs Rogerson and Blanchard's eighth breach of this Rule since 4 October 2011. He said the Stipendiary Stewards submitted that a fine of $100 be imposed.

Mr Laidlaw had no comments to make.

Reasons for Penalty:

It is unfortunate that due to a communication breakdown between Mr Blanchard and Mr Laidlaw JESSIE MAGUIRE was presented without the correct gear. Whilst Mr Laidlaw has admitted the breach the Committee note this is the eighth breach of this Rule by Messrs Rogerson and Blanchard in the last 7 months with the most recent breach being 2 days ago at Auckland when a fine of $100 was imposed.
