Following the running of race 8 an information was filed alleging that S McCaffrey the driver of BY THE STARS used his whip outside the confines of the sulky during the run home on his horse.
Mr McCaffrey did not wish to be present at the hearing.
Facts:
Mr Muirhead demonstrated on the head and side on films the alleged incident in the home straight. Mr McCaffrey was using his whip in a horizontal manner for several strokes, clearly outside the confines of the sulky.

The steward’s recommendation for a first offender with a very good record under the above rule to be in the range of $200.
Reasons for Penalty:
The committee in reaching a decision have taken into account Mr McCaffrey’s very good record and his early admission of the breach. The committee deemed this to be at the lower end of the scale, and in line with previous offences where a fine of between $150 and $250 has been recorded.
