Rule 869 (2) (a) : The information alleges horseman T Mitchell used his whip excessively when driving HEZA HOLMES over the concluding stages of the Race.

Rule 869 (2) (a) : The information alleges horseman T Mitchell used his whip excessively when driving HEZA HOLMES over the concluding stages of the Race.
--Mr Mitchell did not admit the breach and was present at the hearing.
--Mr Muirhead demonstrated by way of a film to the Committee Mr Mitchell’s use of the whip over the concluding stages which showed Mr Mitchell strike the horse with the whip at least 18 times after two groups of what are called backhanders with the whip.
--Mr Muirhead further told the Committee that the Horseman’s Association accepted that UNNECESSARY- EXCESSIVE or IMPROPER use of whip was on offence under Rule 869 (2) (a).
--Mr Mitchell for his part told the Committee that HEZA HOLMES was a lazy horse, needed to be kept up to his work and as he was a very short favourite on this occasion he felt he had to do everything he could to get the horse home, he also added Mr Macy one of the owners of the horse did not find fault with his drive.
--The Committee having carefully considered all of the evidence both verbal and the film shown to them found the breach proven in that Mr Mitchell had used the whip excessively.
--In submissions as to penalty Mr Muirhead described Mr Mitchell as an elite horseman and one whom always gave his horses the best chance of finishing in the highest possible placing, he had no recent charges against him under this rule but was warned on the 1/3/09.
--Mr Mitchell for his part felt he should not have been charged as he was doing everything he could to get the favourite home and had he sat up on the horse could have been charged for not driving it out, if there had to be a penalty he would prefer a fine to a suspension.
--DECISION AND REASON
When arriving at a penalty the Committee took into account Mr Mitchell’s good record and imposed a penalty of $250.00.
