Mr Butcher did admit the breach and was present at the hearing together with his advocate Mr T MacFarlane.

Mr Muirhead told the Committee Mr Butcher was a very promising young driver with no record and asked them to consider a minimum monetary penalty.

Mr MacFarlane on Mr Butcher’s behalf said Mr Butcher was not reckless and on realising his mistake quickly tried to correct same but it was too late, he also told the Committee CRACKER was a horse known to break easily and had done so at its last two starts and had it been another horse it may not have broken.

DECISION AND REASON
--The Committee when arriving at a penalty took into account Mr Butcher’s youth, the fact it was his 1st offence, and his frank admission with the Stewards. They felt a minimum penalty was appropriate and imposed a fine of $200.00.
