| -- DECISION AND REASONS: --The Information alleges that Mr J Dunn, the horseman of THE ICON used his whip excessively on his horse over the concluding stages of Race 5. --Mr Dunn was present at the hearing, and being a junior driver was represented by Mr Tony Shaw. --The rule was taken as read. --Mr Muirhead then demonstrated the film which clearly showed Mr Dunn use the whip excessively over the concluding stages. Mr Dunn, nor Mr Shaw, had any questions of Mr Muirhead or his interpretation of the film. --Mr Shaw asked the Chairman could they change Mr Dunn's plea to guilty, this was done and the Information signed accordingly. --Mr Taumanu, in submissions as to penalty, said he had spoken to junior drivers at Cambridge recently regarding excessive use of the whip. --The Chairman asked Mr Dunn if he was present when Mr Taumanu spoke to junior drivers at Cambridge. He said he was, and in answer to a further question, said he did remember it was about excessive use of the whip. --Mr Taumanu felt a monetary penalty would be appropriate. The Chairman asked for Mr Dunn's record, which was given to him by Mr Taumanu, and Mr Dunn acknowledged that it was correct. --Mr Shaw, on Mr Dunn's behalf asked for a penalty of about $100. --The Chairman took into account all of the facts heard and Mr Dunn's admission of the breach but felt the excessive use was not of a minor nature and imposed a monetary penalty of $200. |
