Facts:
Following the running of Race 7 (SUMMIT REFRIGERATION & AIR C 1400M), at the Taranaki Racing Incorporated Meeting conducted on 7 December 2017, Ms D Johnson the rider of DEVIL MAY CARE was charged with careless riding. It was alleged by the Informant that near the 1200m Ms Johnson allowed her mount to shift inwards when not clear of TITANIUM JACK (S Weatherley) which clipped a heel and blundered.
Due to Ms Johnson having flight commitments the hearing was adjourned until 9 December 2017 where it was held at Trentham Racecourse.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless
Ms Johnson confirmed that she admitted the breach and advised the Committee that she understood the Rule and the charge.
Mr Oatham, appearing for Mr Balcombe, invited Mr Goodwin to demonstrate the incident on the relevant film replays. Mr Goodwin said that near the 1200m Ms Johnson looked across to her inside then allowed her mount DEVIL MAY CARE to shift into the line of running of TITANIUM JACK when only 1 length clear. He said that TITANIUM JACK clipped a heel and blundered. He added that Ms Johnson did pull off TITANIUM JACK but that it was too late.
Ms Johnson for her part said that her horse shifted in for 1 stride only and that she pulled off straight away. She added that she was unlucky in that TITANIUM JACK caught her mount’s inside rear heel.
Decision:
As the charge was admitted it was deemed to be proved by the Judicial Committee.
Submissions for Penalty
Mr Oatham produced Ms Johnson’s record which showed four previous breaches of the Rule in the last 12 months with the most recent being on 7 November 2017 when a 5 riding day suspension was imposed. He said that there was only slight inward movement and that Ms Johnson took corrective action and that she was unlucky in that TITANIUM JACK clipped a heel. He placed the carelessness in the low-end category and submitted that a suspension in line with that be imposed.
Ms Johnson said that it was only minor as her horse had only shifted half a horse width. She asked that any suspension imposed commence after racing on 16 December 2017.
Reasons for Penalty
The Committee, after considering all of the submissions and reviewing all films was satisfied that the carelessness was low-end. The shift by DEVIL MAY CARE was only slight and that the clipping of a heel was indeed unfortunate for Ms Johnson. The JCA starting point for careless riding is a term of suspension of 6 riding days. Taking into account all of the circumstances including the admittance of the breach and record, the committee determined that a 5-day suspension was a suitable penalty.
Penalty
Ms Johnson’s Jockey’s Licence was suspended from the close of racing on 16 December up to and including all racing on 22 December 2017 (5 days).
