Facts:
Following the running of Race 1 (UNCLE RUSSELL GOES TO THE RACES MAIDEN HWT 2000m), Information A11606 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Licensed Class D Rider Ms E Farr. The Information alleged that: "...Emily Farr (DANGERMAN) allowed her mount to shift inwards near the 1700m when not clear of ZABDI (T Moki)".
Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”
Ms Farr confirmed to the committee that she understood Rule 638(1)(d), and that she did admit the breach.
Using the head-on and side-on films, Mr Goodwin identified DANGERMAN racing at the head of the field in the home straight on the first occasion, just passing the 100m. ZABDI was racing in a position closer to the running rail, when Ms Farr had shifted into the line of Ms Moki when not the required distance clear. This forced that horse’s rider to take evasive action at that time. While Ms Moki was entitled to a run, stewards suggested that it was feasible for Ms Farr to have expected her to have taken a hold, but due to Ms Moki’s inexperience, that did not occur.
Ms Farr identified that there was some calling at the time, and that she had looked to her inside on three or four occasions. She agreed that Ms Moki’s inexperience was a factor, but that going into the first corner on a heavy track Ms Moki simply had not made a decision, but decided to sit on the fence. A more experienced rider would have read the situation and taken a hold in advance of the movement, as Mr Riddell had down when approaching the same turn. Nonetheless, Ms Farr accepted that she had taken her line in such circumstances.

Mr Balcombe identified that Ms Farr had a clear record under the rule. The stewards submitted that the carelessness sat within the low range as Ms Moki’s inexperience was a factor that contributed to the incident, but that Ms Moki was still entitled to the run. Mr Balcombe submitted a period of suspension as appropriate.
Ms Farr confirmed that she held a Class D Licence, and asked the Committee to consider the role that Ms Moki’s inexperience played in her facing the charge. She asked for a two day suspension of the upcoming Highweight and Jumps Meetings at Wanganui and South Canterbury.
Reasons for Penalty:
While a more experienced rider in Ms Moki’s position may have handled the situation differently, Ms Farr has accepted that she had taken the line of Ms Moki when not the required two lengths clear. Her movement was gradual, but did require Ms Moki to take a hold. Ms Farr was observed to look to her inside on at least three occasions, which indicates an awareness that she knew there was a runner positioned closer to the rail. The Committee independently assesses the level of carelessness to fall at the low range and considers a period of suspension as appropriate. As the holder of a Class D Riders Licence, the JCA Penalty Guidelines identify a starting point for a low level breach as a 3 National Riding Days suspension. In mitigation we have considered the respondent’s excellent record and early admission of the breach. We consider a two day suspension as appropriate.
