Evidence

Following the running of Race 6 (Fasttrack Insurance Oaks Prelude) (A Listed Race) at the Taranaki R.I. Meeting conducted at New Plymouth on Saturday 3 February 2018 Jockey Mr Bradley was charged with careless riding. Due to Mr Bradley’s unavailability the hearing was adjourned until 6 February 2018 when it was heard at the Wairarapa RC Meeting conducted at Tauherenikau.

The Informant alleged on Information No.A8814 that Mr Bradley angled his mount LUXE outwards when not sufficiently clear of ANEVAY (S Weatherley) which was checked.

Rule 638(1)(d) provides:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be:

Mr Bradley said that he understood the Charge, the Rule and confirmed that he admitted the breach.

Mr Goodwin showed all film replays and identified both horses. He said that LUXE was travelling well and that Mr Bradley angled out and checked ANEVAY near the 200m. He said that it was not a dramatic check but it was evident that Mr Bradley was not clear of ANEVAY when he shifted out and that Mr Weatherley had to take a hold and take evasive action.

Mr Bradley for his part said that he had been riding a patient race and that he had been following the Pike-trained runner who had contributed by shifting outwards. He said that because of that shift he had to come out a bit further. He closed by saying that he was not clear and that Mr Weatherley had to check.

Decision

As the charge was admitted it was deemed to be proved by the Judicial Committee.

Submissions for Penalty

Mr Goodwin placed the carelessness in the mid-range area and asked that the Committee take into account that it was a Listed Race. He added that Mr Bradley had a very good record with his last suspension being on 11 February 2017. He submitted that a term of suspension be imposed.

Mr Bradley in response said that he had rides the following Saturday and would like a deferment until the close of racing on that day. He confirmed that his record was correct and said that he was a safe rider.

Reasons for Penalty

The film evidence was very clear that near the 200m Mr Bradley angled his mount out abruptly across the line of ANEVAY when approximately one length clear resulting in that runner suffering interference. The Committee placed the carelessness exhibited by Mr Bradley as being no less than mid-range. Being conscious of the JCA Penalty Guidelines the Committee started with a suspension of 8 riding days. Due to the event being a Listed Race carrying prize money of $50,000 the suspension was lifted to 9 riding days. Taking into account the admission of the breach and Mr Bradley’s very good record a discount of one day was given.

Penalty

Mr Bradley’s Jockey’s Licence was suspended from the close of racing on 10 February up to and including the end of racing on 22 February 2018.
