As Mr Pinn admitted the breach the charge was deemed to be proved.

Penalty:

Accordingly, Mr Pinn ’s license is suspended from the close of racing tomorrow, Sunday, February 3rd up to and including racing on Thursday, February 28th 2019.

Facts:

Following the running of Race 6 (Fasttrack Insurance Oaks Prelude – Listed Race), an Information was lodged by Mr John Oatham alleging a breach of Rule 638(1) (d) in that W Pinn angled his mount outwards approaching the 1000m when not the required distance clear of JAKKALBOMB.

At the outset of the hearing, Mr Pinn acknowledged he understood the nature of the charge and confirmed he admitted the breach. Mr Sharrock was present as his employer.

The incident happened in the back straight, and Mr Oatham had Mr Goodwin explain the sequence of events using the available films.

Mr Lammas, riding ELATE, made a rapid move around the field to take up the lead position. This left Mr Pinn (MISHA’S STAR) in the trail behind Mr Lammas with Ms Myers (JAKKALBOMB) to his immediate outside. Mr Pinn did not appear to be happy in this position and, showing a lack of patience, pushed Ms Myers’ mount off her line making visible contact with her.  Ms Myers attempted to hold her place, but Mr Pinn kept pushing her out and eventually took her rightful line of running.   Ms Myers ended up behind Mr Pinn. Mr Goodwin said it was the last part of the interference that concerned the Stewards, where after easing Ms Myers out he kept pushing her out culminating in a severe bump.

Neither Mr Pinn nor Mr Sharrock wished to make any comment.

Mr Oatham said the manner in which Mr Pinn had ridden was of concern to the Stewards, particularly the extension of his elbow during the incident. Consideration was given to laying a more serious charge, but after taking into account Mr Pinn’s relative inexperience and the fact that contact occurred, in part, because Ms Myers held her ground, the Stewards gave him the benefit of the doubt.

Mr Oatham presented Mr Pinn’s riding record over the last 12 months. He has had 284 rides in his career to date, and five breaches of the careless riding rule, with today being his sixth.

Mr Oatham said this record was of concern to the Stewards. He described today’s breach as being relatively high on the scale of careless riding. Mr Oatham said the movement of Mr Pinn’s body and the extension of his arm to shift Ms Myers out indicated a deliberate action. A more experienced rider might well have been facing an improper riding charge as a result.

Mr Oatham’s submission was for a suspension in line with the factors outlined.

Mr Pinn and Mr Sharrock both declined to make any submissions on penalty, but Mr Sharrrock advised that Mr Pinn had no upcoming riding commitments and any suspension could begin immediately.

Mr Sharrock left the Committee in no doubt as to how disappointed he was with the ride.

Reasons for Penalty:

The Committee considered Mr Pinn’s carelessness to be high range. His actions were blatant, he displayed little to no duty of care when deciding he wanted out from behind the lead runner and showed no remorse for his actions. While the initial easing out of Ms Myers’ mount may have been reasonable the sustained physical nature of the interference was not.

Safety is absolutely paramount for both horse and rider. Any penalty has to act as a deterrent and send a strong message that this type of riding is not acceptable and will not be tolerated. The Committee hopes that, with experience, Mr Pinn will learn to exercise more patience and display better judgement.

We adopted a starting point of 10 days as provided by the Penalty Guide for Judicial Committees.

Aggravating factors applied were Mr Pinn’s poor record and the fact that the breach occurred in a Listed Race. Mitigating factors were Mr Pinn’s admission of the breach and his relative inexperience.

Taking into account all factors and submissions it was the Committee’s opinion that a 16-day suspension was an appropriate penalty.
