Mr Danis’ Apprentice Jockey’s Licence was suspended from the end of racing on 20 January up to the close of racing on 28 January 2019.

Facts:

Following the running of Race 2 (Taranaki Daily News Supporting Life Education Trust Mdn 3yo) Information No. A12268 was filed with the Judicial Committee. It was alleged that Mr Danis permitted his mount SPRING BLOSSOM to shift inwards near the 900m when not sufficiently clear resulting in crowding CASCADE DE LA VIE, MISS RUMBLE, MARBUZET and OUR HAIL MARY.

Mr Danis said that he understood the Rule and the Charge and confirmed that he admitted the breach.

Mr Oatham showed the film replays and identified all of the horses involved. He said that Mr Danis had been in a 5-wide position racing towards the first bend. He said that Mr Danis shifted in a little when only one length clear which set up a chain reaction to his inside with OUR HAIL MARY and MARBUZET being the worst affected when running out of racing room and having to be checked.

Mr Danis said that at the time he thought that he was a little more clear than he actually was and that the horse to his inside (CASCADE DE LA VIE) was wearing blinkers which did not help the situation.

Mr Harris on behalf of Mr Danis said that Mr Danis did look to his inside but that he was unfortunate that on the bend he let his mount shift a little. He said that having four horses on his inside did not help matters.

Submissions for Penalty:

Mr Oatham said that Mr Danis had a relatively good record with only one suspension being imposed during the last 12 months, that being in May 2018 when a 6 riding-day suspension was imposed for low to mid-range carelessness. He submitted that a term of suspension be imposed.

Mr Danis said that he had commitments up until 20 January 2019.

Reasons for Penalty:

The Committee was satisfied that Mr Danis and his mount shifted in a little in the approach to the first bend with the following horses suffering varying degrees of interference: CASCADE DE LA VIE, MISS RUMBLE, MARBUZET and OUR HAIL MARY. It was the Committee’s opinion that the inward shift was minimal but due to the number of horses on his inside a concertina affect occurred with MARBUZET and OUR HAIL MARY being the worst affected. The Committee independently placed the carelessness in the low to mid-range category and after taking into account that the breach was admitted, the good record and the JCA Penalty Guidelines it was determined that a 6 riding-day suspension was an appropriate penalty.
