The committee found the charge proved.

Penalty:

Mr Riddell is suspended from the close of racing on 8 February 2016, up to and including racing on 14 February 2016. This incorporates the Avondale (10th), Waikato/Manawatu (13th) and Matamata (14th) meetings. 

Facts:

Following the running of Race 2 (Stella Artois 1200m), Information A3367 was filed with the judicial committee. It alleged a breach of Rule 638(1)(d) in that "Rider J Riddell permitted his mount BALLYBAY to shift outwards near the 150 metres resulting in I'M BRONSON having to check."

Mr Riddell confirmed that he understood the rule and that he did not admit the breach.

Submissions for Decision:

Stipendiary Steward Mr Whiterod called Matthew Cameron as a witness. Mr Cameron confirmed he was riding I'M BRONSON, and that passing the 200 metres he observed the horse in front of him (BALLYBAY) to be hanging quite badly. He stated that he received some pressure from his inside as a result of BALLYBAY's outwards movement and that it got "quite tight" half way down the straight. He believed that Mr Riddell's horse had slowly come out, and as a result the gap ahead of Mr Cameron had closed.

Mr Riddell indicated he had no questions for Mr Cameron.

Using the head-on and side-on views, Stipendiary Steward Mr Tidmarsh identified BALLYBAY (J Riddell) racing adjacent to the running rail with I'M BRONSON (M Cameron) positioned to the outside of its hindquarters. Mr Tidmarsh described Mr Riddell's ride as vigorous, whilst his mount was laying out under pressure. He identified that Mr Riddell was not sufficiently clear when shifting out, and as a result had shifted into Mr Cameron's line, who had to check his mount. Mr Tidmarsh submitted that Mr Riddell had not taken the corrective action required, namely ceasing to ride so vigorously with the whip. It was clear on the films that when Mr Riddell stopped riding with his whip, the outwards movement stopped.

Mr Riddell had no issues with Mr Tidmarsh's interpretation of the films.

Mr Riddell advised that BALLYBAY proved a difficult ride as soon as he had got on it. He had also received instructions to be positive, which he had attempted to be. He was going to lay outside of Mr Cameron down the back straight but had elected not to due to the racing manners of BALLYBAY. He used the relevant films to identify that BALLYBAY was hanging for most of the race and that it was on one rein as the field rounded the final bend. He stated that he was in front so had an obligation to ride his best for the connections. He submitted that his last resort was to deliver two backhanders with the whip, which was not in his assessment, vigorous. Mr Riddell stated that he was trying to keep his mount straight and he rejected the assertion that he should have done anything different in these circumstances.

In summary, Mr Whiterod acknowledged that BALLYBAY hadn't been the easiest ride for Mr Riddell, and that it was obvious that the horse was hanging during the race. He believed that Mr Riddell continued to ride with the whip whilst moving outwards. This resulted in the check to I'M BRONSON. Mr Whiterod also submitted that the films clearly indicated that when Mr Riddell stopped riding with the whip, BALLYBAY did straighten up.

In response, Mr Riddell submitted that he did not believe the use of his whip made any difference to the outwards movement or ability of BALLYBAY to straighten.

Reasons for Decision:

The committee considered all of the submissions placed before it. We also had the benefit of reviewing the available films. It is undeniable that Mr Riddell had to contend with BALLYBAY being a difficult ride during the race. This is supported by the films that were viewed soon after the jump. We accept that Mr Riddell has an obligation to his connections to ensure he gave his mount full opportunity. However, this obligation lies alongside the obligations that he also has to other riders in the race. It is clear to the committee from the films and the evidence of Mr Cameron and Mr Riddell that the Respondent was riding in a vigorous fashion. The committee observed from the films that Mr Riddell was on an outward movement approaching the 150 metres and had used his whip on his horse approximately two times too many. This resulted in the check to I'M BRONSON as he was not sufficiently clear. We find that Mr Riddell did not take the required action, which was to put his whip away and take corrective action, rather than continuing to use his whip at that time. 

Submissions for Penalty:

In presenting Mr Riddell's record, Mr Whiterod described him as a regular Raceday rider with two previous breaches of this rule: Wanganui (28/11/15 - 3 Days) and Feilding (27/04/15 - 6 Days). He believed Mr Riddell to have a very good record and submitted that the level of carelessness was minor.

Mr Riddell believed that the level of carelessness should be considered as "very minor". He stated that he rode regularly throughout the North Island including recent riding in the Waikato area, and after conferring with his Racing Manager sought any period of suspension to commence after racing on Monday 8 February.

Reasons for Penalty:

The committee considered all of the penalty submissions placed before it. It adopted the JCA Penalty Guidelines starting point of a 5 day suspension. The committee noted that there were a number of factors in mitigation to apply on this occasion. These included Mr Riddell's very good record, and the contributive nature of the horse's racing manners during the carelessness. While the carelessness resulted in a check to I'M BRONSON over the final stages of the race, the committee also independently assessed the carelessness to sit at the low end. The committee determined that a three day period of suspension was appropriate on this occasion.
