Facts:
Prior to the running of Race 6 (Landmark Homes Maiden), Information A11628 was filed with the Judicial Committee. It alleged a breach of Rule 330(3)(c) and stated that Ms Z Moki “...failed to make the contracted weight for KORBEL”.
Rule 330(3)(c) states:
“A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Ms Moki confirmed that she understood the rule and that she admitted the breach.
Mr Balcombe identified that Ms Moki had contacted the stewards earlier in the morning to advise that she was unable to make the weight for her engagement in Race 6. She had been able to contact the trainer (Mr Bryce Revell) and he had been able to replace her with an experienced rider in Mr Ryan Elliot straight away.
Ms Moki stated that since she had dislocated her elbow, she had problems with her weight, and that the medication she was on was not assisting her in this regard. She confirmed that she was 1 kg over on this occasion and that the lightest she rode at was 55.5kgs.
Submissions for Penalty:
In presenting Ms Moki’s record, Mr Balcombe identified two previous breaches within a few months; namely on 12 October at Egmont ($100) and 7 November at Otaki ($200). Mr Balcombe confirmed that the breach on 12 October was as a result of Ms Moki’s inability to claim her apprentice allowance. He submitted a fine in the vicinity of $300 as appropriate.
Ms Moki had no submissions on penalty, but advised that Mr Nick Bradley had recently been engaged as her agent to manage her upcoming commitments.
Reasons for Penalty:
This Committee notes that the previous two breaches were dealt with via the Minor Infringement system, and that as this third charge falls within the 120 days reset period, an Information has been filed. Ms Moki also understands this. It is fortunate that the connections of KORBEL were able to secure a suitable replacement rider, and as such we do not see any aggravating features of the breach. We also apply no mitigation for admitting a breach of this nature. All of her overweight breaches within the past 12 months have occurred within the last two months, so it will be important that Ms Moki is more diligent in accepting engagements that she is able to fulfil into the future.
