Facts:

Following the running of Race 5 (VAUSE OIL PRODUCTION 2000), Information A6795 alleging a breach of Rule 638(3)(b) was filed with the judicial committee. It alleged that "M Cameron used his whip excessively prior to the 200m when riding KOHI ROAD".

The rule was read and Mr Cameron confirmed he understood the rule and that he admitted the breach.

Using the head-on and side-on films, Mr Goodwin identified that as KOHI ROAD was approaching the 200 metres, apart from a brief respite, Mr Cameron had used his whip on the horse 10 times in quick succession.

Mr Cameron submitted that the incident was clear on the films, and that he had simply misjudged the distance slightly, due to the rail being out on the day. 

Submissions for Penalty:

Mr Goodwin submitted a previous breach of this rule on 2 June 2014, for which he was fined $350. Considering the number of rides that Mr Cameron has, and the estimation that he had had approximately 500 rides since his previous breach, Mr Goodwin described his record as outstanding. In light of the JCA Penalty Guidelines, he submitted a fine of $300 as appropriate.

Mr Cameron had no further submissions to make on penalty.

The committee had regard to the submissions placed before it. We adopted a starting point of a $300 fine. The guidelines exist to mitigate concerns around animal welfare issues and negative public perception. While it has been some time since Mr Cameron's previous breach of this rule, he nonetheless is an experienced rider and suffered a lapse of judgement on this occasion.
