Taranaki RC – 3 July 2008 – Race 10

ID: JCA20799

Hearing Type:
Old Hearing

Rules:
866.1.c

Code:
Thoroughbred

Hearing Type (Code):
thoroughbred-racing

Meet Title:
Taranaki RC - 3 July 2008

Race Date:
2008/07/03

Race Number:
Race 10

Decision: The Information alleges that T Bishop failed to ride CAP COLOMBIE out to the finish of the race

The Information alleges that T Bishop failed to ride CAP COLOMBIE out to the finish of the race.

--

--

Miss Bishop was present at the hearing and was represented by Mr A Schumacher .

--

--

Rule 866 (1)(c) was read and both Miss Bishop and Mr Schumacher acknowledged they understood same, they also confirmed that Miss Bishop admitted the breach.

--

--

Films of the concluding stages of the Race were shown to the Committee and clearly showed Miss Bishop stopped riding 3 strides prior to the winning post.  The horse CAP COLOMBIE was beaten a Nose for 3rd.

--

--

Miss Bishop nor Mr Schumacher wished to put their interpretation on the film.

--

--

Mr Goodwin felt the breach was not of a minor nature as Miss Bishop’s failing to ride her mount out till the finish, had cost that horse a dividend bearing place and he felt a suspension was warranted and should not be less than 4 weeks.

--

--

Mr Schumacher asked the Committee to take into account that Miss Bishop had admitted the breach.

--

--

Mr Goodwin confirmed to Committee that it was Miss Bishop’s first breach of the rule.

--

--

When arriving at a penalty the Committee took into account Miss Bishop’s admission of the breach and her good record.

--

--

However these factors were outweighed by the fact that her failing to ride her mount out had cost that horse a dividend bearing place and warranted a term of suspension and such suspension must reflect that a breach for failing to ride a horse out to the finish cannot be treated lightly.

--

--

Miss Bishop may ride until the conclusion of racing on July 5th 2008 and is then suspended until the conclusion of racing on August 5th 2008.
