--

Stipendiary Steward Mr R NEAL laid an Information alleging that apprentice Jockey Mr C ORMSBY failed to make the carded weight for MISS LOADED in Race 4.

--

Mr Ormsby appeared before the hearing and confirmed to the panel that he admitted the charge and wished to waive his right to representation.

--

Mr Neal told the committee that Mr Ormsby accepted the ride for Miss Loaded at a declared weight of 54.5 kgs. The Clerk of the Scales reported that Mr Ormsby was 3/4 kilogram over the declared weight which exceeded the half kilogram allowance. The Scales had been calibrated 2 days prior to the meeting. Mr Ormsby had told the Stipendiary Steward that he had weighed himself on a set of scales at home prior to travelling to the raceday and was satisfied he could meet the weight restriction for this ride. With this being the third charge of this type in six weeks Stipendiary Steward Mr Neal sought a penalty in the range of $300 to $400.

--

Mr Ormsby told the hearing that he was having trouble with his weight and relied on his own scales to ensure he could meet the weight restriction. He was disappointed when he weighed heavy with the clerk of Scales. Although it was his third offence in the last six weeks he was making a genuine effort and believed he was able to meet the weight. He thought a fine of $250 was appropriate.

--

Decision and Reasons

--

In arriving at this penalty the Committee has taken into consideration

--

his previous convictions for the same offence in the recent past,
