The Protest second against first was dismissed, with authorisation being given for the payments of dividends and prize money on the Judge’s Placings.

Facts:

Following the running of Race 8 (ITM Superior Doors 2000) Information No. A8783 was filed with the judicial Committee. It was alleged by Mr Haigh that the first-placed horse HAMILTONIAN interfered with the chances of the second-placed horse HIGH QUALITY in the final straight.

Rule 642(1) provides:

“If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

Judge’s Placings were:

1st HAMILTONIAN
2nd HIGH QUALITY
3rd NITRO TED
4th EL LUCHADOR
5th TIME BOMB

The Official Margin between 1st and 2nd was a long-neck.

At the request of the Chair all film replays were shown to all persons present without any comment being made.

Mr Haigh said that early in the run home HAMILTONIAN was racing to the inside of his horse and it then commenced to shift out and caused interference to his horse, which resulted in his horse baulking a wee bit. He said that his horse got home very well after the interference and was only beaten by a long-neck.

Mr O’Malley said that approaching the turn his horse was on the flank of HAMILTONIAN and shortly afterwards HAMILTONIAN crossed his line and that this cost his horse about half a length.

Ms Allpress said that her horse always had the measure of HIGH QUALITY. She added that her horse was labouring the last bit and did duck out. She said that Mr O’Malley did not have to stop riding and that HIGH QUALITY had had every opportunity to pass her horse.

Mr Marshment (Trainer of HAMILTONIAN) said that Mr O’Malley did not stop riding, that the second horse did not make up much ground and said that his horse was too good.

Mr Goodwin said that it appeared that both horses shifted out early in the run home and that HAMILTONIAN did then shift out across the line of HIGH QUALITY. He added that at the end of the race HAMILTONIAN was holding HIGH QUALITY.

Reasons for Decision:

The Committee found that near the 200m HAMILTONIAN shifted out across the line of HIGH QUALITY when approximately 1 ½ lengths clear. HIGH QUALITY was then observed to take ground off HAMILTONIAN, however over the final stages HAMILTONIAN was holding HIGH QUALITY with the margin being a long-neck. The Committee observed that Mr O’Malley the rider of HIGH QUALITY was not required to stop riding his mount out and that it was able to be fully tested to the line. The Committee was not satisfied that had such interference not occurred that HIGH QUALITY would have finished in advance of HAMILTONIAN.
