Ms Andrew was fined $300.

Facts:

Following the running of Race 1 (ITM Toolware 1200) Information No.A8780 was filed with the Judicial Committee. It was alleged by the Informant that Ms H Andrew, the Rider of MISS LIZZIE used her whip excessively prior to the 100m.

Rule 638(3)(b)(ii) provides:

A rider shall not: (b) strike a horse with a whip in a manner or to an extent which is: (ii) excessive

Ms Andrew in the presence of Mr Harris said that she understood the Rule, the guidelines, the charge and confirmed that she admitted the breach.

Mr Jones identified Ms Andrew and her mount on all film replays and then said that Ms Andrew had hit her horse 7 times then gave a break of 5 strides, then hit her horse a further 8 times prior to the 100m.

Ms Andrew said that she was still coming to terms with the Rule and was trying to break the habit of using the whip so often.

Mr Harris said that it obviously had not been impressed upon Ms Andrew, the importance of the new guidelines. He said that he tells all Apprentice Jockeys that less is better.

Submissions for Penalty:

Mr Goodwin said that the Rule and guidelines had clearly been breached and submitted that a fine was the appropriate penalty.

Ms Andrew and Mr Harris had nothing further to add.

Reasons for Penalty:

The JCA starting point is a fine of $300 for a first breach of the Rule. The Committee could not see any valid reason for a departure from that figure, accordingly a fine of $300 was considered appropriate.
