The committee are satisfied that had the interference not occurred and Here’s De Consul was given a clear run to the line it would not have finished in front of:
A: Landlord
B : Forbidden
C: Itsanobraina
Therefore the protest is dismissed.
Facts:
Following the running of Race One a protest was lodged pursuant to Rule 642 (1), by G Hennessy in that he alleged interference in the final straight to Here’s De Consul, placed 5th by the Judge from horses Number 1, 10, 9, placed 1st, 2nd, and 3rd respectively by the Judge.
Judge's placing’s were:
1st Itsanobraina (1)
2nd Forbidden (10)
3rd Landlord (9)
4th Karina Rock (11)
5th Here’s De Consul (14)
The official margins being 1/2 length, ½ head, 1/2length, 2 lengths.
The Protest rule was read and confirmed and understood by all present.
Submissions for Decision:
Jockey R Jones spoke on behalf of the connections of Here’s De Consul, and immediately went to the films available, to identify the horses concerned.
Starting after the horses have entered the home straight the winner Itsanobraina (L Allpress) is up outside the leader, the third horse Landlord (O Bosson) is trailing the leader and the second horse Forbidden (M Cameron) out widest, and R Jones on Here’s De Consul is travelling outside O Bosson who pushed him out wider on the bend. On his outside M Cameron is shifting in leaving Here’s De Consul sandwiched in between the two.
His horse has run out of room, loses all momentum, picks itself up and ran on well in the last 50 metres, after being denied all opportunities, and has certainly cost him running in the first three. All three horses have dictated his line to the finish. M Cameron running in and O Bosson moving out, being driven there by L Allpress moving out on to O Bosson.
Mr Hennessy stated that where the interference occurred his horse was only a neck away from both the eventual 2nd and 3rd placed horses, and has run on.
M Cameron said his horse has moved in marginally, and has not made contact with R Jones’ horse and felt the gap was still there after he had moved in the little that he did. It appears there was more movement from the inside horses dictating R Jones' line.
G Thomas reiterated what M Cameron has said with the inside horses putting more pressure on R Jones’ horse even though ours has run in a little. The margin from 2nd to 5th at the finish is a long, long way.
O Bosson stated approaching the 200 metre mark he was making his run when L Allpress has come out into his line of running and he has had to check right back to avoid heels then come back out again. It has stopped my momentum and has cost winning the race.
A Sharrock claims it is self-explanatory - L Allpress has moved out 3 horse widths, stopped O Bosson and loses 1 and ½ to 2 lengths, after the interference.
L Allpress said her horse has won easy and Mr Sharrock’s horse had its chance to pass her, but was prevented by the outside horses running in, and feels Itsanobraina had no effect on the interference concerning the placed horses.
Mr Neal for the Stewards in his observations said the first movement was by M Cameron moving slightly onto R Jones' mount causing that horse some difficulty for a stride or two, then there is the outwards movement when O Bosson is dictated out into the line of R Jones. The issue of the margin which is significant at the finish allowing for Mr Jones being stopped and is running on fairly, has that been enough to compromise him running 1st, 2nd or 3rd, and will leave that decision to the committee to adjudicate on.
Reasons for Decision:
In reaching their decision the Committee have carefully considered all the evidence presented by all connections. The committee viewed the films both head and side on many times. It is clear from the evidence given and the films shown, that there was genuine reason for a multiple protest to be lodged. The outwards movement by Itsanobraina and the inwards movement by Here’s De Consul creating the tightening to Forbidden and Landlord. The committee has a duty to determine, if a placed horse or its rider causes interference to another placed horse, would it have finished ahead of the first mentioned horse, had such interference not occurred. They may place the first mentioned horse immediately after the horse interfered with.
In this case Forbidden who has run in towards but not made contact with Here’s De Counsul has straightened and run on strongly to finish 2nd, ½ head ½ length, and 2 lengths clear at the finish.
Landlord has been forced outwards and into the line of Here’s De Consul, when finishing stronger than both Here’s De Consul and Forbidden, Landlord has possibly suffered more by the outwards movement of Itsanobraina and has run on strongly to be ½ length and 2 lengths clear at the finish in 3rd place.
Itsanobraina has been well clear from the top of the straight all be it causing tightening of the field behind it, finishing ½ length, ½ head, ½ length, 2 lengths clear at the finish. The committee have taken into account the margins by all three horses where Itsanobraina was always in front of Here’s De Consul and running stronger. Forbidden and Landlord have finished very strongly.
