Penalty:

Apprentice Teeluck's licence is suspended from the close of racing on Saturday 23 August, up to and including racing on Saturday 6 September 2014. This includes the Hawera (28th), Hawke's Bay (30th), Otaki (4th) and Wanganui (6th) meetings.

Facts:

Following the running of Race 7 (ITM/New Plymouth Building Supplies Interprovincial 1600m), Information A3312 was filed with the Judicial Committee. It alleged "That N Teeluck permitted his mount (APLOMB) to shift in passing the 150 metres resulting in JOEY JONZ being tightened".

Apprentice Teeluck, assisted by Mr Sharrock, confirmed that he understood the rule and that he admitted the breach.

Using the head-on and side-on films, Mr Tidmarsh demonstrated APLOMB racing to the outside of JOEY JONZ (R Hutchings) in the home straight. Mr Neal stated that Mr Teeluck dictated Mr Hutchings inwards and crowded a number of other runners inwards; approximately two to three horse widths. Mr Teeluck continued on his inwards movement to a point where Mr Hutchings was required to check his mount near the 150 metres. Mr Neal submitted there was no discernible outwards movement of Mr Hutchings, even though it had become tight to his inside. It was clear that he had then been under pressure from Mr Teeluck for some time. At the point where R Hutchings was checked he still maintained his line, but ran out of room due to Mr Teeluck's attempts to gain a better finish. Mr Neal believed Mr Teeluck should have desisted with his whip use and attempt to straighten his mount much sooner than he did. It was submitted that Mr Teeluck moved inward from a position of eight wide at the point of the turn to five wide further down the straight; coming in at least three horse widths when there hadn't been sufficient room provided to those runners located to his inside.

Mr Teeluck believed he did take a hold of his mount and stopped using his whip, but he accepted that by that stage the damage had already been done. Mr Sharrock believed that at the time that Mr Hutchings had taken a hold, Mr Teeluck had also done so as well, albeit slightly later than he could have. Mr Sharrock also commented that Mr Teeluck had done his best given he hadn't been riding in New Zealand for long.

Submissions for Penalty:

Mr Neal submitted that Apprentice Teeluck had received one suspension for careless riding on 28 April 2014 within the previous 12 month period. He believed him to be an apprentice who was starting to get a number of rides and was becoming one of the promising apprentices in the Central Districts area. In relation to this incident, Mr Neal submitted that APLOMB was hanging, and Mr Teeluck simply did not do enough sooner to relieve the pressure on Mr Hutchings. Accordingly, the stipendiary stewards submitted the level of carelessness to be at the low to mid end. He also confirmed that Mr Teeluck had 95 raceday rides and his record could be considered as a good one.

Mr Sharrock supported Mr Neal's submissions and asked the judicial committee to consider Mr Teeluck's good record for an apprentice who had 95 raceday rides to date. Mr Teeluck confirmed that he rode exclusively within the Central Districts area and that any period of suspension could commence immediately.

Reasons for Penalty:

The committee considered all of the submissions placed before it and adopted a starting point of a five day period of suspension. In relation to the circumstances surrounding this incident, the committee place the level of carelessness within the low to mid range. In mitigation, the committee considered Mr Teeluck's very good riding record for an apprentice. He has already had 95 raceday rides since his entry into the New Zealand riding ranks. We also considered his early admission of this breach and his co-operative attitude during the hearing process. These considerations were balanced against the requirement for him to take corrective action, and display a duty of care, at an earlier stage than he did. The total stakes for this race was $50,000, and Mr Teeluck's carelessness over the concluding stages meant that runners were affected at a vital stage of the race. A four day period of suspension was considered appropriate on this occasion.
