Decision:

The Committee was satisfied that Mr Bradley was responsible for the interference that had occurred and the charge of careless riding preferred against him under the provisions of Rule 638(1)(d) was upheld.

Penalty:

Mr Bradley’s Jockey’s Licence was suspended from the close of racing on 28 July until the end of racing on 15 August 2018 (8 days).

Facts:

Following the running of Race 7 (SANDFORDS RURAL CARRIERS SC MDN 1400) Information No. A8819 was filed with the Judicial Committee. The Informant alleged that Mr Bradley angled his mount CURRAHEE LAD inwards when not sufficiently clear of SKY HI RAHTWO which was dictated inward onto DESTINY ONE which in turn was dictated inward onto LEAF which was checked near the 1250m.

Mr Bradley confirmed that he denied the breach and advised the Committee that he understood the Rule and the Charge. Mr Bradley was advised by the Chairman of his rights and it was explained to all present the procedure that the hearing would follow.

Rule 638(1)(d) provides:

A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless

Submissions for Decision:

Mr Jones, Stipendiary Steward, gave evidence for the prosecution. His evidence was that shortly after the start Mr Bradley and his mount gradually shifted in after starting out wide and then near the 1250m shifted in more sharply when only 1 ¼ to 1 ½ lengths clear of SKY HI RAHTWO. As a consequence SKY HI RAHTWO (Z Moki) was dictated onto DESTINY ONE (C Waddell) which went inwards onto LEAF (J Riddell) who received a significant check. All relevant films were shown during Mr Jones giving evidence.

In answer to a question from Mr Bradley Mr Jones reiterated that he was only 1 ¼ to 1 ½ lengths clear when he shifted into Ms Moki’s line of running.

Ms Moki, the Rider of SKY HI RAHTWO was then called as a witness. She said that she had been urging her mount up to hold her spot. She said that the outside horse left her a bit short when it came across. She said that it was about a half-length clear and that she went in and put pressure on Ms Waddell and her horse.

Mr Bradley did not have any questions.

Ms Waddell, the Rider of DESTINY ONE was the next witness for the prosecution. She said that she and her mount were angled in by Ms Moki’s mount when it came onto her and that the inside rider (Riddell) was calling out but that she could not move out due to the pressure from her outside.

In answer to questioning from Mr Bradley Ms Waddell said that the calling from the inside was when the incident was happening and that she did not know that Mr Bradley was on the outside until she saw the film replay.

Mr Riddell the Rider of LEAF was the final witness. He said that he was trying to ride forward and that it got very tight on his outside. He said that he got no help from his outside and that they should have relieved the pressure. He said as a consequence of the tightening his horse got on heels and was checked out of its position. He added that he could not see who was responsible at the time.

In answer to a question from Mr Bradley, Mr Riddell said that he yelled before he got checked and that he gave a decent yell as he got checked.

Mr Bradley was then given the opportunity to put his case before the Committee. He said that Ms Moki had ridden her horse with vigour from barrier rise. He said that he was coming across gradually, and that he heard Mr Riddell calling for some time and he could tell that it was tight. He said that he was only 1 ¼ to 1 ½ lengths clear because Ms Moki had hunted up. He said that he did pull off and that he did not think that he was 100% careless. He added that Ms Moki was careless in continuing to hunt up and put pressure on inside horses.

In answer to a question from the Committee, Mr Bradley said that he came across gradually and only moved in 5 horse-widths over 200m. He said that most riders on his inside would have used common sense and taken a hold and ridden a race.

SUMMATION

Mr Goodwin said that Ms Moki could have pulled back but that it was not her obligation to do so. He said Mr Bradley was not clear when shifting and horses were forced down onto Mr Riddell and he was checked.

Mr Bradley said that he was not asking Ms Moki to pull back but only take a hold. He said that it would have been common sense to ease back and avoid Mr Riddell being checked. He added that there were mitigating circumstances and that he could not be blamed 100% for what had occurred.

Reasons for Decision:

The Committee gave due consideration to all of the evidence and again revisited the film replays. After starting from towards the outside of the field Mr Bradley and his mount commenced to shift across towards the inside runners. Near the 1250m when no more than 1 ½ lengths clear, Mr Bradley shifted into the line of SKY HI RAHTWO who in turn was forced down onto DESTINY ONE’S line and as a consequence that runner shifted down onto LEAF who ran out of room and was relatively severely checked. Ms Moki could have pulled/eased back, however it was not her responsibility to do so, it was Mr Bradley’s obligation to ensure that he was the required two lengths clear when shifting in across the path of another runner. Ms Moki had taken ownership of her spot and was entitled to remain in such position.

Submissions for Penalty:

Mr Goodwin said that Mr Bradley had a very good record with only one suspension for careless riding in the last 12 months, that being in February 2018 when an 8-day suspension was imposed. He placed the carelessness just above mid-range and said that a term of suspension would be appropriate. He added that Mr Bradley is forthright and honest at all times. He said a mitigating factor could be Ms Moki’s inexperience in that she kept kicking up inside Mr Bradley.

Mr Bradley said that he agreed with Mr Goodwin in that Ms Moki could have eased instead of kicking up. He said that he did not admit the breach as he believed he was not at fault. He added that he has a very good record insofar as careless riding is concerned and asked for any suspension imposed to commence after racing on 28 July 2018.

Reasons for Penalty:

The Committee placed the carelessness exhibited by Mr Bradley above mid-range and having regard for the JCA Penalty Guide adopted a starting point of 9 riding-days suspension. Taking into account the very good record a discount was given. In fixing quantum of penalty the Committee was mindful that 3 horses were affected with one of those horses receiving significant interference.
