As the breach was admitted it was deemed to be proved by the Committee.

Penalty:

It was determined by the Committee that Ms Parkes Apprentice Jockey’s Licence be suspended from the close of racing on 8 November up to and including racing on 15 November 2018 (5 days).

Facts:

Following the running of Race 5 (Landmark Homes Mdn) Information No. A09659 was filed with the Judicial Committee. It was alleged by the Informant Mr Jones that Ms Parkes allowed her mount GREAT NORTH ROAD to shift inwards when not sufficiently clear of CUIDADO CALIENTE (V Colgan) which was checked near the 100m.

Ms Parkes was assisted by Mr Andrew Parkes. Both persons said that they understood the Rule, the charge and Ms Parkes confirmed that she admitted the breach.

Mr Oatham showed the relevant film replays that showed Ms Parkes and her mount shifting into the line of CUIDADO CALIENTE near the 1100m when only approximately ¾ length clear. This resulted in Mr Colgan, the Rider of CUIDADO CALIENTE having to firmly check his mount to avoid heels.

Ms Parkes agreed with what was shown on the film replays of the incident and had nothing further to add.

Submissions for Penalty:

Mr Jones said that it was Ms Parkes' second day of race riding and only her third race ride. He placed the carelessness in the low-range category and submitted that a suspension in line with that degree of carelessness would be appropriate.

Ms Parkes said that she would prefer any suspension imposed to start after 8 November.
