As Mr Moore admitted the breach we find the charge proved.

Penalty:

The committee grant deferment to Mr. Moor’s suspension as per rule 1106 (2).

Mr. Moor’s jockey license is suspended from the close of racing on Saturday 25th February up to and including the 4th March 2012.(Eight (8) Victorian riding days), and a fine of one thousand dollars $1000.

Facts:

Following the running of race 6 the Platinum Homes (NZ) 2YO Classic Group 3, an information was filed pursuant to Rule 638(1) (d) in that the informant Mr Goodwin alleged Mr Moor permitted his mount Ockams Razor to shift in approaching the 200 metres causing tightening to Platinum Kingdom and Liberating which were checked.

Mr Goodwin read Rule 638(1) (d) A Rider shall not ride a horse in a manner which the judicial committee considers to be : (d) careless, Which was confirmed and understood by Mr Moor. Mr Moor an Australian rider confirmed he understood the New Zealand Thoroughbred Racing Judicial procedure and endorsed he admitted the breach.

Submissions for Decision:

Mr Goodwin proceeded in going straight to the films, head, side, and rear films were used to identify where at about the 200 metres Mr Moor riding Ockams Razor had on his inside from the running rail out Miss R Myers (Liberating) Mr J Parkes (Reais) Mr M Cameron (Choice Bro) Miss D Johnson (Swiper The Fox) Miss K Myers (Platinum Kingdom).

Mr Moor is riding with some vigour and his mount begins to run inwards into the line of Platinum Kingdom, forcing the rider of Swiper The Fox to take evasive action, as Mr Moor continues to ride his horse along then draws the whip whilst doing so.

At this point the tightening is of the severity that the back end of Reais is turned and at the same time is directed into the line of the improving Choice Bro, who was entitled to the run he was making at that point, which in turn has forced Liberating down on the inside to be checked. Mr Parkes may have made a very slight movement out, but the majority of movement has come from the outside by Mr Moore while continuing to ride his mount out.

The pressure is not being relieved while the riders on his inside are all being crowded. Mr Moor eventually relieves the pressure by straightening his mount but all too late. The damage has already been done. Mr Goodwin stated the majority of the incident affects Platinum Kingdom, and Liberating.

Mr Moor in response informed the committee as the films show he has clearly moved in first, then when he has used the whip that is the major incidence. Although admitting guilt when he did tighten the runners on his inside, he did not eliminate the run M Cameron was looking for outside J Parkes mount when it closed, it was not all his doing, and when going back to the inside that is when J Parkes affected the run of Liberating of his own accord, and does not feel he has had a great bearing in that situation. However he does admit full guilt to the interference to Platinum Kingdom and Swiper The Fox. Leading up to the incident he did try to steer him off but when cut with the whip his mount has moved in far too quickly and when pulled off it was two strides too late.

Submissions for Penalty:

Mr Goodwin presented a very good riding record for Mr Moor who has only been suspended once in the previous twelve months, that being 23rd October 2011, prior to that was in 2009, having had approximately 200-250 rides since October. This incident has tightened several riders, in particular Miss K Myers, and Miss R Myers receiving checks and the stewards believe a suspension is the appropriate penalty and to be in the vicinity of ten days.

Mr Moor in presenting his submissions highlighted the number of rides he has and a suspension of any length would have financial implications on him and his family. Any suspension would not be taken lightly as the competitive nature of riding in Australia is such that if you lose a ride, you may not get it back.

When questioned by the committee Mr Moor indicated he would average between fifteen and twenty mounts per week. Mr Moore displayed acceptance to the committee when questioned if a penalty by way of a suspension of lesser days but to include a fine were to be imposed. Mr Moor asked the committee to consider his exemplary riding record and his admission of the breach, and sought a deferment of seven days to fulfill his immediate riding commitments.

Reasons for Penalty:

The committee has carefully considered all the evidence and submissions presented and have viewed the films available. In ascertaining the degree of carelessness the committee find the continued inwards movement by Mr Moor’s mount and the check to two horses and the tightening of three others puts this incident in the mid to high range. With a starting point of five days to commence a penalty by way of a suspension the committee may adjust accordingly either up or down. The mitigating factors in this circumstance point favorably at the excellent riding record of Mr Moor and his early admission of the breach. The committee compliments Mr Moor for his frank and honest co-operation throughout the hearing. In aggravation it was clear from the films Mr Moor has continued to ride his mount out with vigour using the whip and whilst his actions have clearly caused a check to both Miss K Myers, and Miss R Myers Mr Moor’s actions have had a significant bearing on a number of subsequent runners. Mr Moor has only attempted to correct his line after the incident. The committee emphasis the need to maintain integrity and public confidence, with safety, they must be a priority at all times and on this occasion Mr Moor tested the criterion.

Taking all the above into account and also the “ Platinum Homes 2YO Classic is a Group Three “ race of significant value, the committee believe a period of suspension is appropriate.

Submissions presented in regard to a “combined” penalty including a fine have also been considered and the committee has taken the number of days and races Mr Moor is involved with riding in Victoria, and will impose a monetary penalty in addition.
