Mr R Jones stated I Robot’s movement out denying the line REUBEN THORN was entitled to in the run to the finish and has cost REUBEN THORN about one length.

Mr J Jago admitted he did move out but Mr Harris never stopped riding his horse and never lost any ground and kept his momentum right through.  Mr Jago stated that the horse that finished third came from behind and bet REUBEN THORN

Mr K Gray confirmed Mr Jago’s statement.

Mr Goodwin supports the statements from Mr Jago and Mr  Gray that the third horse has come from behind REUBEN THORN that has been balanced in time and has the distance to run on to the line approximately 150mtr, and that the status quo remains.

The committee carefully considered all evidence and reviewed the films available.  The films clearly show an outward movement from I ROBOT taking REUBEN THORN off his line, because it was momentarily and at no stage did Mr Harris stop riding his mount whilst travelling in a forward momentum.  We have also considered where the incident took place and the manner in which the horses finished out their race and the margin of a head at the line.

The ground lost if any, was minimal, and we do concur that the third horse came from behind and was finishing the race the stronger at the line.

We therefore dismiss the protest. Judges placings stand 4, 3, 10, 1
