Stipendiary Steward Mr N Goodwin lodged an information alleging Mr J Jago allowed PREEMO to shift in when not clear of ENCHANTED which had to be checked near the 800m.

Mr Goodwin read the rule and the breach was admitted by Mr Jago.

The relevant films were shown where PREEMO (J Jago) moved inwards when not the required distance clear and checked ENCHANTED.

The committee heard submissions on penalty from Mr Goodwin stating this was not at the top end of the scale but Mr Jago had moved in after looking and was not the required distance clear.

Mr Goodwin made the committee aware that this was Mr Jago’s first offence with no previous warnings.

Mr Jago confirmed he looked but misjudged moving inwards.

After viewing the films and taking into account Mr Jago’s admittance of the breach, the committee impose a term of suspension from the date of 16 February 2008 up to and including the date of racing 23rd February 2008 (4 days).
