GOLDMINER was denied a fair start and is declared a non-starter.

Facts:

Following the running of Race 5, Information A3152 was filed with the Judicial Committee, seeking a Request for a Ruling. The information stated “That GOLDMINER was denied a fair start.”

Rule 632 states:

“(1) If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

The rule was read and understood by all present.

Submissions for Decision:

Using the head-on film, Mr Neal identified GOLDMINER which had drawn barrier one and was being attended to by the starter’s assistant due to it becoming fractious. Mr Neal stated that an attendant had been requested for GOLDMINER prior to the race. The ruling was being sought as it appeared from the films that when the barriers were released, the attendant appeared to still have hold and control of the horse in question; therefore denying it the opportunity to start fairly with the other runners.

Mr Misbah concurred with Mr Neal, stating that the starter’s assistant held on to his horse too long and that as a result this had cost GOLDMINER lots of ground.

The starter, Mr Clement, stated that the assistant had agreed that he had held on to GOLDMINER too long due to its fractious behaviour.

Further, using the side-on film, Mr Neal demonstrated the consequences of GOLDMINER being denied a fair start, as it was a 1200m race and Mr Misbah’s mount was not even in view on the side-on monitor after the start had been effected.

Reasons for Decision:

It was clear from the films that GOLDMINER was fractious prior to the gates opening. The head-on film clearly identified the starter’s assistant still having a hold, and control, of GOLDMINER, Whilst the side-on film indicated the amount of ground that the horse lost. The committee therefore was satisfied that GOLDMINER was denied a fair start on this occasion.
