Accordingly the protest was upheld and new placings confirmed as:

4th (3) GINGERBREAD MAN

The committee authorised the payment of dividends and stakes in accordance with its decision.

Facts:

Following the running of Race 1 (Graphix Explosion Maiden Highweight) Information A6819 was filed with the judicial committee. It instigated a protest under the provision of Rule 642(1) alleging that JUS TINKIN placed first by the judge interfered with the chances of ZEDACE placed second by the judge. It alleged interference over the concluding stages.

The provisional placings were:

1st (7) JUS TINKIN
2nd (4) ZEDACE
3rd (1) ALTIPLANO
4th (3) GINGERBREAD MAN
5th (9) BORNINASANDPIT
6th (5) CHICO RIO

The margin between first and second was a short head.

Stipendiary Steward Mr Goodwin identified the runners concerned on the available side-on and head-on films as they approached the final 100 metres.

Submissions for Decision:

Mr Walsh stated that he was riding his horse with the stick, and that coming to the winning post JUS TINKIN had veered out, making contact with his horse and continuing to push ZEDACE outwards. He also stated that he had to cease using his whip and from the side-on film he believed his horse had "motored on again" after the interference and that had such interference not occurred he would have won the race.

Mr Bambry believed the side-on showed that Mr Walsh was required to stop riding and that the Myers runner had clearly moved outwards making contact with his horse's shoulder. He submitted that the contact had stopped ZEDACE's momentum and it was clear that he was going to go past JUS TINKIN prior to the interference.

Mr Harrison referred to the mown strips to identify that ZEDACE had moved inwards approximately one width during the run down the straight as it was inclined to lug in. He did not believe Mr Walsh had stopped riding as a result of contact being made. He also believed JUS TINKIN was always going to win as it was going too good.

Miss Kennedy had nothing further to add.

Mr Goodwin was invited to make comment on the incident. In doing so, he submitted that the alleged interference had taken place over the concluding 30 metres of the race. His assessment identified that Mr Bambry's horse had moved in slightly, but that such movement was insignificant with no bearing on the interference. He stated that the interference came from the sharp outwards movement of JUS TINKIN when it had ducked out under pressure. He submitted that ZEDACE was finishing resolutely down the outside and had had its momentum impeded by the outward movement of Miss Kennedy's mount. He identified that ZEDACE was putting in again and ran the other horse to a short head margin at the line.

Reasons for Decision:

It was clear that shortly after approaching the final 50 metres interference had occurred. This was supported by the available films, and established that such interference was attributed to the outwards movement of JUS TINKIN. Our assessment indicates that ZEDACE was hindered for three strides and its momentum had been compromised as a result of the outwards movement from JUS TINKIN. We observed on the side-on film that ZEDACE was finishing strongly and started to regain its momentum at the line, and was finishing better than JUS TINKIN. The winning margin was only a short head and the committee was satisfied that had the interference not occurred, ZEDACE would have beaten JUS TINKIN.
