As the charge was admitted, the committee found the charge proved.

Penalty:

Mr Holmes' licence is suspended from the close of racing on Sunday 21 September up to and including racing on Thursday 25 September 2014. As Mr Holmes is returning to Queensland, this incorporates four Queensland Race Meetings (Monday 22nd, Tuesday 23rd, Wednesday 24th and Thursday 25th). He is available to accept rides for Friday 26th September onwards. 

Facts:

Following the running of Race 4 (Graphix Explosion Maiden 1100m), Information A3361 was filed with the judicial committee. It alleged a breach of Rule 638(1)(d) and stated that "P Holmes allowed his mount GOLD PROMISE to shift in near the 900 metres when insufficiently clear of SMOKED which was checked". Mr Holmes confirmed he understood the rule and that he did admit the breach. 

Using the back-straight film, Mr Tidmarsh identified GOLD PROMISE (P Holmes) and SMOKED (V Johnston) shortly after the start was effected. Mr Goodwin commented that Mr Holmes, whilst running reasonably greenly, allowed his mount to shift inwards near the 900 metres, shifting into Miss Johnston's line, causing her to take a hold of her mount and lose approximately two lengths in the process.

Mr Holmes stated that while Miss Johnston's horse was over racing, making it slightly more difficult for her, he confirmed he was not sufficiently clear on this occasion. He had no further comments regarding the incident.

Submissions for Penalty:

Mr Goodwin confirmed that Mr Holmes had a good record, and had presented such submissions for the previous hearing into Information A3360. He believed the penalty submissions to be of similar nature, although suggested further mitigation for Mr Holmes' early admission of the breach, and submitted a period of suspension of four race meetings.

Mr Holmes agreed with Mr Goodwin and had nothing further to add when asked. 

Reasons for Penalty:

The committee had regard to the penalty submissions placed before it. We believed a period of suspension to be appropriate and adopted a starting point of five days suspension. We placed the level of carelessness at the low range as had Mr Holmes commenced his inwards movement a stride or two later than he did, the carelessness may not have resulted. In mitigation the committee considered Mr Holmes' very good riding record and his early admission of the breach. Applying these combined mitigation aspects, the committee determined that a four race meeting period of suspension was appropriate. It was noted that this committee had previously suspended Mr Holmes' licence from the close of racing on Wednesday 17 September up to and including racing on Sunday 21 September 2014. Accordingly, any period of suspension would be applied cumulatively to his existing period of suspension.
