The Information alleges that J McDonald allowed his mount to shift out when not clear of THE GEORGIAN who was checked and KEEP THE MESSAGE who was jostled for several strides.

Mr McDonald admitted the breach and was present at the hearing together with Licensed Trainer SA Sharrock who was representing him.

The rule was read and both Mr McDonald and Mr Sharrock acknowledged they understood same.

Mr R Neal (Stipendiary Steward) demonstrated Head-on and Side-on films of the alleged incident – neither Mr McDonald nor Mr Sharrock had any questions of Mr Neal nor did they wish to put their interpretation on the films.

The films shown clearly showed Mr McDonald riding with vigour when his mount was continuing on an outward movement, this caused Mr Lammas the rider of THE GEORGIAN to take evasive action and in doing so jostling Mr Walker’s mount KEEP THE MESSAGE.

The Committee were given Mr McDonald’s record which showed he had been charged under this rule on the following dates 15.2.08 – 16.2.08 and most recently 24.3.08 Mr McDonald acknowledged the dates as given were correct.

Mr Sharrock asked the Committee when arriving at a Penalty to take into account Mr McDonald’s admission of the breach and the fact he did ride a lot.

The Stipendiary Stewards felt the breach was not of a minor nature and warranted a term of suspension.
----
When arriving at a penalty the Committee took into account Mr McDonald’s admission of the breach also his record which was pretty good considering the amount of rides he has, however these factors were outweighed by the fact his lack of corrective action to his mount had caused a severe check to one horse and that in turn had affected the run of another. They were of the view a term of suspension was warranted and suspended Mr McDonald from the conclusion of racing on Saturday 17th of May until the conclusion of racing Saturday 24th May. A stay of proceeding of 7 days was requested and granted.
