Facts:
Following the running of Race 6 (Fasttrack Insurance Oaks Prelude, Listed Race), an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that R Myers allowed her mount SEVEN SEAS to shift in when not clear of ALOFT (D Johnson) which was checked in the home straight.
Ms Myers confirmed her understanding of the charge and her admission of the breach.
Mr Goodwin had Stipendiary Steward Mr Jones identify the runners involved and explain the incident using the videos. He showed Ms Myers riding SEVEN SEAS on the extreme outside of the field with a large number of horses to her inside. Three-runners in was Ms Johnson riding ALOFT, who at that time had a clear and direct run to the line. Ms Myers proceeded to shift in when not sufficiently clear of ALOFT and as a result, Ms Johnson was forced to check her mount. Mr Goodwin said there was a slight outward movement from Mr Bradley, which may have contributed to Ms Johnson having to check.
Ms Myers said her inward movement was minimal and Mr Bradley definitely moved outwards but conceded that Ms Johnson did get checked.

He assessed Ms Myers' degree of carelessness to be below midrange and said she was a rider who seldom caused the Stewards any concern.
Ms Myers was invited to make submissions on penalty. She said her record was good and advised of riding commitments through until next Friday, February 7th at Manawatu.

The Committee considered all submissions.
In our opinion, the incident sat just above the low end of careless riding. Ms Myers clearly drifted in over the final stages when only approximately ¾ length clear of ALOFT. There was no attempt to correct her mount’s line of running, and Ms Myers went on to win the race. ALOFT did not feature in the first 6 placings.
We adopted a starting point of 7 days in accordance with the Judicial Committee Penalty Guide. An aggravating factor was the Listed status of the race with stake money of $55,000. In mitigation, Ms Myers was forthright with her admission of the breach. Her record we considered a neutral factor.
