| -- DECISION AND REASON: --The information alleges the Mr C Ormsby, the rider of HIPPO SUPREMO allowed his mount to shift outwards when not the required distance clear of SEDAKA (V Johnston) resulting in that rider having to check her mount in the home straight. ----Mr Ormsby admitted the breach, was present at the hearing and was represented by his employer Mr G Searle. The rule was read and Mr Ormsby and Mr Searle acknowledged they understood it. ----Mr Bateup demonstrated head-on and side-on videos of the alleged incident. Mr Ormsby nor Mr Searle did not have any questions of Mr Bateup, nor did they wish to give their interpretation of the videos shown. ----Mr Oatham then gave the committee Mr Ormsby's record, which he and Mr Searle acknowledged was correct. Mr Oatham felt the interference caused was not of a minor nature and warranted a term of suspension. ----Mr Searle, on behalf of Mr Ormsby, felt the outward movement was more of a gradual nature than a sharp or sudden outward movement. ----All parties acknowledged that they had a fair hearing, had nothing further to add and left the judicial panel to arrive at a penalty. ----The committee took into account all of the evidence, both verbal and the videos shown to them, they also took into account Mr Ormsby's admission of the breach. They considered the breach to be not of a minor nature as Mr Ormsby had continued to ride his mount with the whip when on an outward movement and did cause Miss Johnston to check her mount. ----His record was not good, having been suspended for a month in October and then received a further three days on the 4 December 2004. His admission of the breach was out weighed by the serious nature of the breach and his record. ----The committee suspended Mr Ormsby from riding, from the conclusion of racing on 27 December 2004, until midnight on the 15 January 2005, in effect five days ? namely, Stratford 31.12.04, Hastings 01.01.05, Tauherenikau 02.01.05, Woodville 08.01.05, and Manawatu 15.01.05. ----Mr Searle had asked the committee if Mr Ormsby may ride at Stratford on the 31 December 2004 as he had already accepted three rides for that day. As withdrawals were not until 11am on 28 December 2004, this request was denied. -- |
