Information 7984 was heard at the Taranaki Jockey Club’s meeting in New Plymouth on 12.6.08.  It refers to a breach at the New Plymouth Race Course on the 11.6.08.

The information alleges that Miss J Hibarger failed to wear an approved body protector as per NZTR board directive. whilst riding trackwork at New Plymouth on Wednesday the 11 June 2008.

Miss Hibarger was present at the hearing together with her Employer Mr A Sharrock.  The rule was read and both Miss Hibarger and Mr Sharrock acknowledged they understood same.

Miss Hibarger also confirmed to the Committee that she admitted the breach.

Mr Sharock told the Committee that he had continually told her  (Miss Hibarger) that she must wear an approved “safety vest” when working horses and that she had on at least three occasions prior to the 11th June failed to do so.

Mr Goodwin for his part told the Committee that “safety vests” were to be worn for rider’s safety and that ample warnings had been given that the not wearing of same would result in penalties.

He also informed the Committee of recent breaches in the South Island and the penalties for same.

Miss Hibarger for her part said she normally wore a ”safety vest” but sometimes forgot.

In answer to a question from the Chairman however she did admit that her Employer Mr Sharrock had warned her about the not wearing of same on numerous occasions.

When arriving at a penalty the Committee took into account Miss Hibarger admission of the breach but this was heavily outweighed by the fact that she had been a multiple offender in spite of warnings and any penalty must show disapproval and reflect her multiple offending and a fine of $800.00 was felt appropriate.
