Mr Ching, stipendiary steward, alleged that Mr Bates, the rider of JUST RHYTHM in race 2 made a celebratory gesture prior to passing the winning post. Mr Bates admitted the breach which we thus find proved.
----We accept the matter is at the bottom end of the scale for a breach of this rule, as Mr Ching suggests. It was a muted celebratory gesture, a couple of strides before the line when Mr Bates was well clear of the field, in recognition, he says, of the trainer’s birthday.
----Significantly, Mr Bates has no previous breach of this rule. Mr Ching has asked for a fine in the range of $100 to $200. Taking these matters into account, plus his ready admission of the breach, we fine Mr Bates half of his riding fee which we calculate to be $270. Mr Bates is fined the sum of $135 and reminded him of his obligations under the Rules of Racing.
