Mr Mudhoo’s licence is suspended for 3 days. This is from the end of racing on 26 December up to and including 29 December 2020. He is also fined the sum of $250 as provided in the Guidelines.
Facts:
Mr Davidson alleged that in Race 5 Mr Mudhoo (LET ME TELL YA) rode carelessly in that he permitted his mount to shift ground when not sufficiently clear crowding and checking THE SELECTION (J Lowry) passing the 200 metres.
Miss Haley demonstrated on the films that Mr Mudhoo was racing towards the outside of the field in the home straight with Mr Lowry and Mr Johnson to his outside. He shifted outwards and into the running line of Mr Lowry who had to check his mount off the heels of Mr Mudhoo and shifted outwards in so doing. Mr Johnson was momentarily inconvenienced.
Mr Davidson said there may have been contact with Mr Lowry but that it was not apparent from the video.
Mr Moseley said the Respondent had pulled the right rein and shifted out. Mr Mudhoo had then come into the running line of Mr Lowry. Mr Mudhoo had straightened his mount, which was under a ride with the stick, just a fraction too late. There was only a stride or two in it.
Mr Mudhoo said Mr Moseley’s analysis of the videos was correct. He had heard yelling and had corrected his mount. He said his horse had been laying in initially and he was correcting this.
Mr Davidson agreed with Mr Mudhoo’s explanation, stating Mr Mudhoo had gone to straighten his mount but had shifted too far.
Submissions for Penalty:
Mr Davidson produced the Respondent’s record which showed one breach of this rule on 5 January this year. The Respondent has had 320 rides since then. He said this was an extremely good record. He described the breach as low range.
Mr Mudhoo did not disagree with Mr Davidson’s comments.
Mr Mudhoo sought a deferment of the suspension until after the Wingatui meeting on 26 December. The Informant did not disagree with this.

The breach is low-range. Mr Mudhoo has shifted outwards on the track and come into Mr Lowry’s running line. Mr Lowry has had to check his horse and change ground and in so doing has slightly inconvenienced Mr Johnson who was to his outside.
The Committee has regard to the revised Penalty Guidelines and takes a starting point of 4 days. Mr Mudhoo’s record is very good. He has one breach of this rule in a 12-month period. He is a busy South Island rider. A day’s credit is appropriate for this and his admission of the breach.
