Facts:

Following the running of Race 3 Blatch Racing and Advance Agriculture Maiden an information was filed by Stipendiary Steward Mr. J. McLaughlin against Jockey Mr. Selvan alleging that he made a celebratory gesture prior to the winning post.

Mr. Selvan admitted the breach.

Rule 638 (2).

Stipendiary Steward Mr. Allison showed the side on and head on video replays of the final 50 metres of the race. Mr. Allison identified Mr. Selvan beginning the gesture about 40 metres from the winning post with his whip held high above his shoulder about two metres from the winning post.

Mr. Selvan stated that he had made an error of judgement. He had become very excited about the prospect of winning two races in a row and also was overjoyed for Mr. Jack Gordon whom he had ridden for over twelve years.

Submissions for Penalty:

Mr. McLaughlin submitted that Mr. Selvan had recently returned from New Caledonia in November 2015 and had ten race day rides. Mr. Selvan had no breaches of this rule. Mr. McLaughlin submitted the breach was mid to lower range.

The JCA penalty guide recommends a starting point of $300 penalty.

Reasons for Penalty:

The committee assessed the gravity of the breach to be mid-range.

There were clear safety concerns due to its extravagant nature taking into account his ready admission of the breach and his record
