Facts:
Mr. S. Dickson admitted a breach of rule 869 (4) “in that he drove in a manner likely to cause interference, when shifting inwards into the passing lane just short of the winning post causing ‘Cup of Life’ (N. Chilcott) to steady and shift out”.
This breach of the rule was held over from the Stratford Trotting Clubs meeting on the 5th of February 2012, and heard prior to race one at Manawatu.
Mr. Dickson agreed with the course of action taken and reiterated his guilty plea.
As the charge was admitted the breach was found proved.

All available films of the incident were shown to the committee and Mr. Taumanu pointed out the effected horses.
Mr. Dickson came from 5 across after leaving the mobile to be down on the inside of Miss Chilcott approaching the winning post, the first time. Mr. Taumanu believed that Mr. Dickson’s actions denied rightful position to Miss. Chilcott who had to steady and move out.
Mr. Dickson had no comment.
Mr. Dickson informed the committee the incident looked worse on video and he felt he was entitled to move across looking to be down on the rails.
Submissions on Penalty:
Mr. Taumanu asked for a penalty that reflected in his view the severity of the incident which he classed in the mid range. He believed Mr. Dickson’s record under this rule was clean but did concede that in February 2011 Mr. Dickson was suspended and his drive disqualified for a breach of rule 869 (4).
Mr. Taumanu using the Judicial Control Authority penalty guide asked for either a period of suspension or a fine. It was pointed out that Mr. Dickson only drove in the Central Districts and occasionally at Cambridge Raceway.
Mr. Dickson submitted that his preference was for a period of suspension to be imposed and concurred that he only drove outside the CD area at Cambridge.
Reasons:
In coming to our decision to impose a period of suspension we have taken into account your admittance of the breach and your record under this rule. We were mindful of your preference for a period of suspension and on checking the Harness Racing programme we found that there are no meetings scheduled for Cambridge until March and that the next harness meetings in the Central Districts are set down for the 21st and 23rd of February.
We are of the opinion the movement could be classed in the mid range but did note Miss. Chilcott was inconvenienced by your actions even though it was at the start of the race.
Penalty:
Mr. Dickson, you are suspended from race driving from after the completion of racing tonight the 9th of February until the completion of racing on Thursday 23rd of February 2012 (2 days).
