Following Race 3, Licensed Horsewoman N Chilcott was charged under Rule 869(5). The information stated: ”You failed to trail with your horse’s head behind the seat of the horse in front of you between the 1200m to the 800m.”
Rule 869(5) states:

Ms Chilcott was not present for the hearing, but had indicated on the Information that she did admit the breach of the rule, and that she did not wish to be present at the hearing. As the Information had been signed by the respondent, the committee proceeded with the hearing of the Information.
Using the available films, Mr Wallis identified Ms Chilcott (CUP OF LIFE) racing four back on the fence as the field approached the 1200m. At this point the films indicated Ms Chilcott angling half out, and she remained in that position, sitting on RYANS WAY’s wheel, which was located immediately in front of CUP OF LIFE. The stewards submitted that Ms Chilcott remained in the position until the 800m mark. At the 800m mark, Mr D Butcher (CHANGE GEAR) moved to the inside of CUP OF LIFE, forcing Ms Chilcott to make the decision to move out four wide. Mr Taumanu submitted that Ms Chilcott had effectively ‘half-carted’ for a very long distance, which was not helpful to others runners as they were unable to make progress. He added that Ms Chilcott could potentially make other runners work harder and/or cover extra ground if she elected to move out at the point when others sought to move to the outside of CUP OF LIFE in order to make a run.
Submissions for Penalty:
Mr Taumanu noted that the JCA Penalty Guidelines identified a starting point of a fine of $200. He indicated to the committee that he had told Ms Chilcott that the stewards would be submitting a fine of $200 as the appropriate penalty. There was no indication on the Information from Ms Chilcott or otherwise regarding a submission as to penalty.
Reasons for Penalty:
Ms Chilcott was charged with a breach of Rule 869(5). Whilst she elected to not be present at the hearing, the committee was able to review the incident in question via the available films. In light of this, the committee also considered the submissions put before it, and whilst the JCA Penalty Guidelines indicated a starting point of a $200 fine or a suspension of four (4) drives, the committee believed a monetary fine was appropriate and adopted a starting point of $200. In mitigation the committee took into account Ms Chilcott’s early admittance of the breach. The mere nature of ‘half-carting’ does cause some uncertainty for other runners who may not be afforded the best possible tactical options to make progress during the race. The significant distance for which Ms Chilcott undertook the process of ‘half-carting’, some 400m, is also an aggravating feature. On this ocassion, the committee believed that the mitigating feature was equally counter-balanced by this sense of aggravation, and that the starting point, as adopted, was an appropriate quantum for penalty.
