Following the running of Race 5 an information was lodged by Stipendiary Stewards instigating a protest alleging Captain Bushrat (9) placed third by the judge suffered interference by Mighty Springfield (10) placed second by the judge, in that Mighty Springfield locked wheels in the run home with Captain Bushrat.

Margins between 2nd and 3rd placing is a neck.

Mr J Stormont represented the connections Captain Bushrat (9).

Mr P Ferguson represented the connections Mighty Springfield (10).

Mr T Taumanu, Stipendiary Steward, demonstrated on the films available that there is a clear case for relegation, with Mighty Springfield (10) moving out and locking wheels in the run home with Captain Bushrat (9) and the interference in the run to the line to Captain Bushrat, and the margin at the finish being a neck.

Mr Ferguson confirmed he was unable to maintain his line and locked wheels.

--

Mr Stormont confirmed Mr Taumanu’s evidence.

Mr Ferguson elected not to contest the protest.

Decision.

--

The committee in reaching their decision agree, the video clearly shows the outwards movement and the locking of wheels has:

--

(a)    affected the forward momentum of Captain Bushrat

--

(b)   the distance of approx 50 metres from the finish,

--

(c)    the margin of a neck ,

--

(d)   The honesty by both parties.

--

The committee upheld the protest.   The amended placings are 5, 9, 10, 6 and 8.
