Charge:
The Stipendiary Stewards lodged an information alleging a breach of Rule 330 (3) (a) in that Mr Waddell wilfully and without reasonable cause broke his riding engagements for KEEPER OF KEYS in Race 2 and O’RIGHT ZEN in Race 6. This was heard at Trentham on Saturday January 21st 2012.
Facts:
Mr Goodwin told the committee on the morning of the Stratford races he received a phone call from Mr Darryl Anderson (Mr Waddell’s agent) advising him that Mr Waddell would not be attending that days race meeting. The weather was terrible and out of the eight rides he was engaged for five had been scratched and he couldn’t make the weight on one of the remainders. Mr Goodwin asked if Mr Waddell was ill, and if he was, then he would be required to provide a medical certificate before racing the next day at Ellerslie. Mr Anderson said Mr Waddell was not ill and accepted that he might be facing a charge for wilfully breaking a riding engagement.
Decision:
As Mr Waddell admitted the breach the charge was found proved.
Submissions for Penalty:
Mr Goodwin made a submission for a fine of not less than $400. He said two horses had been affected but there had been adequate replacement riders and none of the trainers had been put out. Mr Waddell had no previous charges under this rule.
Mr Waddell explained he had been riding for four days straight and was mentally and physically exhausted. Despite wasting he had ridden at Taupo the previous day, a half kilo over his carded weight. When he got up on the morning of the Stratford races he realised he wouldn’t be able to make the weight for one of his rides which left him facing seven hours travelling for only the two rides. With a big days racing ahead the following day at Ellerslie he said he didn’t believe he was up to going to Stratford. He would have got a medical certificate but being New Years Eve there were no doctors open. He said he had put himself in a bad situation and had paid the price for doing so.
Mr Waddell urged the committee to consider his circumstances. This was his first breach of this rule and he was about to begin a 12 day suspension for another charge.
Reasons for Penalty:
The committee considered all of the submissions and consulted the penalty guide which suggested a starting point of $300. Mitigating factors for Mr Waddell are his clear record under the rule and his admission of the breach. Aggravating factors are two lots of connections were affected as well as the betting public - Mr Waddell has a large following due to his success in recent times.
The committee could understand the reasons why Mr Waddell elected not to travel to Stratford and could not criticise him for this however the mistake he made was in accepting rides there in the first instance. In the future Mr Waddell would be wise to think more carefully about his wasting and his physical capabilities when planning his riding schedule.
Penalty:
We imposed a monetary penalty of $350.
