Following the running of race 2, the McCarvill Family Memorial Maiden, Mr Grylls was charged with careless riding under rule 638 (1) (d).  The information alleged that “ C Grylls permitted his mount (PARTEE ON) to shift out near the 200m when not clear of THE BENEFACTOR (J Parkes) which was checked and dictated outward hampering the runners to its outside.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless

Mr Grylls indicated on the information he admitted this breach of the rules.  He also agreed he understood the charge and the rule it was laid under.  As the breach of the rule was admitted the charge was proven.

Stipendiary Steward Mr Goodwin showed the head-on and side-on films of the incident.  Mr Goodwin said at approximately the 200m point Mr Grylls, who was racing behind AGNOPAK ridden by Ms R Myers, angled his horse out for a run and whilst riding with vigour bumped Mr Parkes on THE BENEFACTOR causing a chain reaction to the runners on the outside of Mr Parkes. Mr Goodwin said that in Mr Gryll’s defence the horse had overreacted to some extent but if he had not angled his horse out and instead waited for a run the interference to the outside horses would not have occurred.  Mr Parkes was entitled to a clear run to the line and did not receive it due to the significant outward movement of Mr Grylls which in turn had a “concertina affect” on three other horses - EYESONELLA (C Parish) which received a significant bump, OUTWARD BOUND (M Hills) and TING ALING (S Khadir).

Mr Grylls said that when angling his horse out it had ducked out and over reacted.  He said that even though he was riding forward, at the same time he had attempted to straighten his mount by pulling his arm out to gather the reins which probably wasn’t the thing to do as he didn’t manage to completely stop his outward movement.  He re-iterated, however, that he had attempted to straighten his mount.

Penalty Submission

In relation to penalty Mr Goodwin said Mr Grylls had not been charged under this rule in the last 12 months. He was a busy sought after rider who rode throughout the country and had an exemplary record.  He said when interference has occurred to a number of horses normally the stewards would be seeking a suspension of between 5 and 6 days.  However, on this occasion he thought the interference was in the low to medium range and the chain reaction following the initial bumping to Mr Parkes made it look worse than it really was.  He believed a suspension of 4 days was appropriate.

Mr Grylls said he had a good record for the number of rides he gets.  He confirmed he did not wish to seek a deferment of any suspension under the 7 day rule.

Decision

--

In coming to a decision on penalty the Committee has carefully considered the incident as shown on the films and all the submissions put before it.  We have taken into account Mr Grylls’ admittance of the breach and his excellent riding record.  We believe the incident is in the mid range noting that in moving out Mr Grylls has attempted to straighten his horse but at the same time continued riding with vigour and denied Mr Parkes his rightful running line which in turn has caused a chain reaction and impacted on three other runners.

Mr Grylls is suspended from the conclusion of racing on Sunday 3 January 2010 until the conclusion of racing on Thursday 7 January 2010, that being 4 riding days – Otaki (4/1), Whangarei (5/1), Reefton (6/1) and Waipukurau (7/1)
