Following the running of Race 1, the "J Swap Stockfoods 2000" Information A3265 was filed by Co-Chief Stipendiary Steward Mr R Neal. The Information requested a Ruling in relation to Rule 632 "In that the gates for "Torrado" and "Vicki Jane" were slow to open and the Committee is requested to determine whether these two horses received a fair start".
Rule 632 states:- "If in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in the race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse(but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter".
At the beginning of the hearing the Committee advised Mr Neal that "Vicki Jane" ridden by Ms Thornton had finished 3rd and therefore no ruling was required in relation to that horse. Mr Neal agreed and amended the Information to delete the reference to 'Vicki Jane". He asked that Ms Thornton remain at the hearing to provide any assistance required by Ms Chiong.

Mr Neal used the head-on and side-on films to show the start of the Race. He said the head-on film clearly showed that gates 1 and 2 were slow to open.
Ms Chiong, the rider of "Torrado" who was drawn in gate 1, confirmed it was slow to open.
Mr Fleming, the trainer of "Torrado", advised that Ms Chiong was asked to ride the horse as handy as possible. He said the side-on view showed that she may have lost half a length as a result of the gate being slow to open. He said the horse had ended up running sixth but he doubted it would have run in the first three.
In conclusion Mr Neal said it was a 2000m race, gate 1 had been slow to open but "Torrado" had got going quite quickly and the issue was whether jumping out about half a length behind the rest of the field had prevented the horse from taking an effective part in the race.
To a question from the Committee Mr Fleming stated his horse had every chance once it had jumped to be ridden up along the rail and he did not believe the chances of "Torrado" were prejudiced.
Reasons for Decision:
The Committee has reviewed the available films of the start. It is quite clear that gates 1 and 2 were slow to open and that "Torrado" in gate 1 was approximately half a length behind the rest of the field when it left its gate. However, because gate 2 was also slow to open Ms Chiong would have been able to hunt her horse up along the rail as there was ample room for her to do so. Mr Fleming said his instructions to Ms Chiong were to try and ride the horse handy and whilst that wasn't possible from the start he was very clear in stating that the chances of "Torrado" were not prejudiced by the gate 1 opening slowly.
